It was reported in the media that Registrar of Societies (ROS) director-general Abdul Rahman said that the fresh CEC election should be made through a national congress and not the special national congress.

It is so baffling that he has uttered such remarks as this simply shows that he has not fully read or understood DAP’s constitution.

Or is it because he understood but is trying to make things difficult again for the DAP for some political reasons?

DAP constitution empowers the CEC election to be held either through a national congress or a special party congress. These are clearly stated in the party’s constitution.

For the national congress to be held, 10 week notice is required to be given to branch secretaries so as to allow branches to have more than sufficient time to hold meetings to propose resolutions, party constitutional amendments or specific business for tabling at the congress and to nominate candidates for CEC election. (CEC candidates are nominated by branches and there are multi businesses in a national congress which includes the election of a new CEC.)

A special party congress is held for specific business and for the special party congress; a notice of not less than seven days is required to be sent to all branches and delegates.

As there was no controversy over the candidate list used in last December’s congress which was disputed, it has been decided that no fresh nomination is required and hence the CEC decided to conduct fresh election through a special party congress to be held on Sept 29.

If no fresh nomination is required, is it not logical to hold the fresh nomination as soon as possible through a special congress?

Notices were already sent out earlier to give delegates more than sufficient notice about the special congress. PKF accountants and business advisers have been appointed to act as scrutineers for the election although there is no provision in the DAP’s constitution that an external accountant should be appointed. They had already reviewed and scrutinised the dispatch of notices sent out to the delegates.

I had on Sept 20 said that ROS has no reason to ask for the original letters from 500 plus delegates who had confirmed that they were notified about the last December congress but were not able to attend. I have then asked - what more does ROS want?

Today, I repeat- what more does the ROS want?

I wish to remind Abdul Rahman that his decision to direct a fresh CEC election without assigning a reason is most unjust and unprofessional. He has also become a most political ROS with his frequent media remarks.

He must realise that till today he still owes the DAP and the nation an explanation for his decision.
