The Chief Justice's criteria for promotion of judges appears to be sound but in practice is unsound. How will he explain that a very senior judge, very conversant in law and having written some landmark judgements in the country still lacks the capability to be elevated to the Federal Court whilst new and junior judges having apprenticed under him are now above him?
