Cops to probe assault, but not custody battle

Ren Ai: Inspector-general of police (IGP) Khalid Abu Bakar is a civil servant caught between his allegiance to his religion and his duty under the constitution.

 

His salary from taxpayers' money is remuneration for being the IGP. And IGP is what he should be, and he has a solemn duty to defend civil law to his last breath.

 

This case however has become complicated as the government, and its multiple differing voices, is not able to decide by principles and instead allows emotions and personal interpretations to get in the way.

 

The IGP’s dilemma is self-induced as no one can refute him if he follows civil law. Unfortunately, it appears that he is not made of sterner stuff.

 

Shanandoah: IGP, if you are not able to protect the civil laws of this country and defend it against all other - whatever that may be - you are totally unfit for your job.

 

The federal constitution is for all citizens in this country. Protect it and enforce its provisions. Haul up anyone, irrespective of his or her race and religion, and bring the culprit to face the laws of this country.

 

A kidnap has taken place, and nothing is being done. Wake up, IGP, before another airliner gets lost without any trace with its cargo of mangosteens.

 

Anonymous_3f4b: There is no two systems. The police force was set up pursuant to civil law and derives its powers from the secular constitution and civil laws passed by the secular Parliament.

 

It is the legal duty of the police to act when a civil court order has been infringed. No doubt, this transgression falls under the ambit of contempt but this is also a case of forced abduction bordering on child kidnapping which evokes criminal sanctions.

 

The Royal Malaysian Police (PDRM) must take all necessary action, pre-emptive or otherwise, to nab the offender and return the child to its lawful custodian.

 

The police must not be bound by syariah law or the syariah courts as the founding fathers of the Malayan Constitution never envisaged the country to be run by the ulamas and their syariah enforcers.

 

On that note, it is high time for Parliament to return the civil courts to its former eminence lest the conflict between civil and syariah will lead to absurd and ineffective enforcement.

 

SimonTi: The real problem lies with those among us and those in authority who have neither the will nor inclination to protect all Malaysians and uphold the constitution, the supreme law of the land.

 

Aries46: Surprisingly, Khalid appears toned down compared to his earlier defensive stance not to probe the matter. Based on Khalid’s summary of what appears to be a long-running tussle between this couple - there are numerous police reports, violation of court orders, assault and so forth.

 

There was one arrest and four investigation papers were opened. Since he has refrained from divulging anything more, we just have to take him at his word hoping that these are not mere words.

 

This is how our civil service functions, cover-ups and flip flops as witnessed in the recent MH370 crisis.

 

But his contention not to act on the custody dispute is untenable as the unilateral order of the Syariah Court is binding only on the convert father whereas the civil court order is binding on both parents and is the law of the land that he is duty bound to enforce.

 

Nevertheless since he now calls for a contempt order, has he got the will to enforce it once it is issued?

 

Ferdtan: Yes, IGP Khalid, why the clarification now? Why the tone of the statement now is mild and accommodating now?

 

Your earlier press statement that you cannot take any action against the criminal father who took his son by force was arrogantly loud and uncompromising. Why had changed since then?

 

You cannot take too many criticisms including one from the Tourism Minister, Nazri Aziz, former de-facto law minister?

 

It has being said that the police follow the law and not interpret the law themselves; but that was what you did by jumping the gun with your earlier statement.

 

If there was doubt in the interpretation of the law then they should get the advice from the Attorney-General’s Chambers. To us, it makes no difference as the AG’s office was never fair in its dealing; they interpret laws ‘Umno-style’.

 

Meanwhile, the police should detain the father and investigate him on assaulting and kidnapping charges and put the son in the custody of a neutral party - the Social Welfare Department - before any legal decision is made.

 

But no, Khalid you became the judge yourself. You decided there was no case. Period. Are you a police official or a judge?

 

Vijay47: I suppose two idiotic statements in one day is about par for the Malaysian course.  First we have Tony Fernandes grandly decreeing that AirAsia will now move to KLIA2 since “Putrajaya has decided to enlist the expertise of the ICAO”. 

 

But your concern was in respect of depressions along the taxiway and apron. How does appointing someone to examine these issues lead to them disappearing? The airport defects suddenly healed themselves overnight? 

 

And of course you cannot leave out the required salute to “the priority that the government is giving to the issue of safety”.

 

Next we have that other clown who considers himself the IGP, generously suggesting that S Deepa file for contempt of court against her husband who kidnapped her son.

 

You state that if the court rules in her favour, you will act against her criminal husband. But there already is a court order granting her custody of her child. Why is that not enforceable but contempt by the same thug can be acted on?

 

Senior Citizen: Mr IGP, listen here. What you just said clearly proves that you have failed miserably as the chief of the PDRM. Honestly you are the worst IGP in the world, and I mean it.

 

You should have thought about this earlier but not after proving yourself as a failed IGP Please do the right thing. If there is an ounce of dignity left, please resign and let someone more intelligent and more qualified take over.

 

LogicalMalaysian: What do people expect the police to do? The syariah and civil courts both have given custody of the children to different parent. This is a problem the leaders are supposed to sort out.

 

Mushiro: Since the MH370 incident, I noticed many of our officials who make a statement quickly make an about turn in a new statement soon after.

 

Some claimed they have been misquoted and some even go to the extent of removing their statements from the Hansard.

 

Khalid was re-clarifying his own statements for himself. It looked like he did not understand what he had said earlier.
