Still awaiting final judgment on Khir Toyo

YOURSAY ‘I wonder how some people always fall sick at the right time?’

Khir in hospital, graft appeal put off for 3rd time

Pemerhati: There is strong possibility that all these postponements are being orchestrated.

Normally the BN big guns and their cronies are brought to trial before the elections to fool the public into thinking that it is not corrupt and is serious about fighting corruption.

In the past, nearly all of the accused have been eventually released after ‘sandiwara’ (show) trials (for example, former transport minister and ex-MCA chief Ling Liong Sik).

It would be too risky for Umno to convict any of these big guns because that would make them very angry and they would then start ‘singing’ and implicate many other big guns holding top positions who are much more corrupt.

What therefore happens is that a big ‘sandiwara’ is carried out where the big gun will be eventually found not guilty at a suitable time.

Anonymous_1404801070: I had spondylosis before and the pain was from the shoulder to the arm, especially when sleeping. During daytime, there was no pain because of mobility.

I was cured by physiotherapy using traction i.e. in a lying position, a neck collar strapped to a machine which pull/release, pull/release.

According to the doctor, it's due to too much computer work resulting in a lack of mobility. I recommend former Selangor menteri besar Dr Mohamad Khir Toyo to get a traction machine and do it in prison.

Kilgore: We shouldn't be surprised; Khir has always been a pain in the neck to Selangor.

Sabahan: Ask any doctor and he/she will tell you that migraine and cervical spondylosis are totally unrelated. If Khir wants to lie, at least lie properly.

Do not just use some medical terms and think the deputy public prosecutor (DPP) and judges will be fooled.

By the way, cervical spondylosis only affects the arms, not the legs. Lumbar spondylosis affects the legs.

Anticommunalist: Anybody aged 50 years and above will have some form of cervical spondylosis. Pinching of the nerve causing migraine? Go take Panadol like the rest of us.

Anticonmen: This sounds like Fathi Ahmad's, (a director of Pahang Consolidated Ltd, which he and his appointees robbed) case in 1975 when he was about to be sentenced for forgery by Justice Harun Hashim.

Fathi's lawyers gave a medical certificate to Justice Harun but the judge said, "Is he that sick to attend court? Bring him to court even if he is on a stretcher. If he does not attend today, I am issuing a warrant of arrest."

Subsequently, Fathi came running and attended court and was sentenced for forgery. Those were the days of the brave, no-nonsense judges.

Amochai: Any more Harun Hashims in the Malaysian judiciary today?

Abasir: A nice variation from the usual angina and heart attack. Maybe a lengthy psychiatric evaluation is also in order. One has to determine whether he is emotionally distressed at being found guilty of corruption and sentenced to 12 months’ imprisonment.

Clearly, he will not be able to argue his appeal under those circumstances, Shafee Abdullah or no Shafee Abdullah.

Ferdtan: So Khir Toyo's famous defence lawyer, Muhammad Shafee, has gotten the Khir case postponed for the third time.

The excuse for the second time was the most ridiculous of all; Shafee had to attend a law conference in Japan. The whole court was made to wait for him. DPP public prosecutor Masri Mohd Daud did not oppose. So nice of him.

Now compare the two sides of Shafee - one as a prosecutor and another as defence lawyer. In Anwar Ibrahim Sodomy II's case, the whole proceeding at the Courts of Appeals was apparently rushed through due to the expected by-election in Kajang whereby Anwar was to contest in the 'Kajang Move'.

The appeal hearings took I believe only two days and on Friday, March 7, 2014, after the court having worked overtime up to late evening (an unprecedented happening), it found Anwar guilty and sentenced to five years’ jail.

Anwar's lawyer late Karpal Singh had then sought a one-week adjournment to prepare for mitigation. It is normal in most cases that time is given to prepare for mitigation. Now compare the reason given by Anwar with the one given by Khir for an adjournment.

Anwar's: "On Monday (over the weekend March 10) Anwar will have to be present in Parliament as the king will open the House and on Tuesday he will deliver his speech as opposition leader," Karpal said.

Wasn't that more important to the one given by Khir's lawyer Shafee? Now what did DPP Shafee do. He objected to the request. The judges headed by Balia Yusuf Wahi gave Anwar's team only one hour to make the mitigation.

Imagine the judges waiting til the late evening just to hear the mitigation. If you are in Umno, everything is possible even for a criminal suspect like Khir Toyo.

Chedet: Who is the doctor who gave Khir the medical certificate (MC)? I want want him to check my toe nail.

Well Thats Fantastic: He knows now is not the time for his boss to "help" him as BN is already under the microscope for many other dubious court decisions.

Swipenter: I always wonder how some people always fall sick at the right time.

Dont Just Talk: Khir gave a broom to a district officer to sweep their compound but he forgot to sweep his own backyard, resulting in the severe migraine.

During his heyday as menteri besar of Selangor, he thought that he was untouchable and after Selangorians showed him the door, all his wrongdoings hit the fan.

Yet PM Najib Razak made fun of YB Dr Wan Azizah Wan Ismail (Kak Wan) as unsuitable to be the next menteri besar of Selangor.

Anonymous_40f4: If Pakatan doesn’t submit many, many names by Sept 3, will Khir be made MB again?
