YOURSAY ‘Who have the authority to erase immigration records?’

Court: Musa couldn't have aided in Altantuya case

Wg321: The prosecutor, the defence and the judge were replaced in less than 24 hours before the trial started in the lower court.

Throughout the trial, during the examination-in-chief and cross-examination of Sirul Azhar Umar, pertinent questions that were related to the motive factor were not asked by all parties. They are:

1) Did anyone offer money to Sirul to kill Altantuya?

2) Who supplied him with C4 explosives?

If Sirul named Musa Safri that offered him money, then he should be called to the witness stand for further questioning to establish the money trail that may led to the mastermind.

By not asking these pertinent questions to establish the motive factor (mens rea) throughout the trial, there is obviously a cover-up.

The alleged mastermind could be a very powerful man. He can order the Immigration Department to erase her immigration records so that there is no proof she is in Malaysia.

Definitely there is a miscarriage of justice in Malaysia. I hope the Australian court should take note of this during the judicial review of Sirul’s extradition.

Mushiro: The five-member bench headed by Chief Justice Arifin Zakaria is an insult to themselves and an insult to the Malaysian judiciary.

The court did not determine the mastermind of the murder and the motive of the murder and yet the five-member bench feels it was fine not calling DSP Musa Safri who is the only person that Sirul and Azilah took orders from.

Musa Safri could have revealed both the mastermind and the motive of the murder. The objective of this trial was to hide and protect some big names and find a scapegoat to satisfy the public.

Odin: All right, Federal Court judge Suriyadi Halim Omar, whatever you say. For now, that is.

But when you have recovered from your state of confusion, grogginess and stupor, we will be most grateful if you will be so kind as to answer this one utterly simple question - is it logical for two men to simply go out there, snatch a woman who is unknown to them, take her to a secluded place and annihilate her?

Annihilate her means total extermination.

Swipenter: Justice must be done and must be seen to be done. Every law student, lawyer and judge surely must know that and now the public too.

There are just too many unanswered questions and it was obvious that someone (powerful) wanted to conceal the murder by blasting the victim to smithereens and by erasing her immigration records.

The two convicted UTK (Special Action Unit) personnel did not have a motive and had never met the deceased until that fateful night. It is hard to believe that they took the initiative to murder her and blast her to pieces thereafter. And for what purpose? Some pieces of jewellery?

And they have the authority to get her immigration records erased thereafter? Why would anyone wanted Altantuya's existence be erased.

All leads, no matter how remote, must be investigated and addressed in court.

FellowMalaysian: Remember the president of the Court of Appeal in his verdict in acquitting Azilah and Sirul at the appellate court pronounced that it was a fatal error of the prosecution in not calling Musa Safri in the witness stand?

Now the apex court has totally discredited the wise judgment of their peers. Bolehland's Federal Court judges never fail to amuse.

Victor Johan: The two convicted murderers must surely have a motive to conduct the crime of murder.

They were surely instructed to murder Altantuya, a woman whom they did not have prior dealings nor relationship with. We just want to know and establish who gave the instructions to this gruesome murder.

It's a crime of murder and the public has to know who did it and why. Period.

Pemerhati: It looks like all the judges involved in the case are going all out to protect the person/s who ordered Sirul and Azilah to murder Altantuya.

Their behaviour reflects very badly on them, the judiciary and the country. Malaysians and foreigners cannot be blamed for having absolutely no confidence in the judicial system of Malaysia.

Negarawan: Can the ‘learned’ chief justice and judges answer one simple question: What's the motive for the murder?

There has been no effort on their part to really understand the motive, and the real culprits behind the motive. Again, it is the judiciary which is on trial here.

4W4K3N1N6: Musa could have confirmed (should he be called to the witness stand) that he did not receive any instruction from his boss. Isn't that good enough reason to clear the PM's name?
