Putrajaya to patch loopholes in rape law

De facto Law Minister Nancy Shukri has promised that legal loopholes in the laws on rape will be resolved.

"As the minister in charge of law, rest assured that those who exploit the loopholes will be brought to justice.

"I look forward to working with everyone in improving our laws... If you have any feedback, do not hesitate to forward it to me," Nancy said on her Facebook page yesterday.

She said the attorney-general was reviewing Section 375 of the Penal Code to expand the definition of rape.

"At present, forceful penetration by fingers does not constitute rape under Section 375. This is intolerable," she said.

Nancy was referring to the Court of Appeal decision to free Bunya Jalong on rape charges on grounds that there was no penile penetration.

The court accepted the testimony of Bunya, 60, that he inserted his semen-stained fingers into the 15-year-old girl’s private part, which made her pregnant.

Nancy said that she has written to the Attorney-General's Chambers to seek a judicial review of this case.
