The empty land next to my house in Pahang started to be developed in the year 2006. While they were doing their foundation works, water started to seep through the walls of our house. Almost every month, we made an effort to talk to the developer at their office but they did not respond positively.
As the building took shape, the problem of water seeping through our walls from the front to the back, ie, from the car porch to the kitchen continued with all the walls damp and wet. We took the matter up to them (the developers) again in 2007 but again our pleas fell onto deaf ears.
Later in the year, after much complaint and bringing up of the matter to our local council which is Majlis Perbandaran Temerloh, the developer sent their contractor to paint up our walls but sad to say, about two months later, the problem recurred.
We brought the matter up again with both the developer and the local council but until today they have failed to rectify the matter. We have not requested any compensation at all. We only wish for our house to be restored to its normal state.
Apparently, right now, the situation of our walls has worsened - there are more cracks and certain parts of the wall are still wet. We have only requested a five year guarantee from the developer but they have turned us down instead.
Quoting us some housing acts through our local council, they said that their guarantee will only hold for two years only. We are only commoners and do not understand if the act/law they quote is applicable in this situation.
Largely, this is because our house is an old house and it was not built by the said developer. What we understand is that the said act applies only to newly-built buildings.
We are the victims in this whole scenario. We find from the last letter from our local council has that they are very annoyed over this matter and trying to quickly shelve this problem.
We are only the ‘David’ and we can’t deal with this ‘Goliath’ financially, legally or in any other way. We are the little people. We appeal for help and assistance from anyone out there who can see to some justice done to this matter.
