  • I refer to Idrus' letter on the Moorthy issue where he blames the implementation and not the law.

    I am against this kind of rationale simply because the law is not exhaustive or thorough and leaves a gap for interpretation - too big a gap.

    What recourse should I have if I were to kick the bucket tomorrow and a group show up at my house to claim my body? Do I need to get a statutory declaration that I am not a Muslim before I die and carry it with me? Then again, the courts will rule that the declaration is null and void as it cannot interfere.

    What we are concerned is that the High Court has failed in its duty to fully examine whether Moorthy's conversion was absolute. It abdicated it powers completely and did not address the very conversion itself.

    If the court had established that the conversion was bona fide, then non-Muslims will lay their hands off the Moorthy case. Sadly, this was not ascertained and the law needs to be changed to address this issue in the future firmly and not leave it to implementation or imagination.
