I only hope the culture of criticism and condemnation of the judiciary or its judgments will not perpetuate in this country as is the case of the Metramac case. This will stifle the growth of righteous judgments being delivered by the judges.

In fact, Justice Gopal Sri Ram has paid a heavy price in not being promoted to the Federal Court for many years now. This due for having delivered the right judgments without fear or favour that were not palatable or conducive to those in high positions. He has been a judge of conscience.

We also have judges in the system who are without conscience and take the easy way out such as the High Court judge who administered the judgment on the late M Moorthy case. His ruling caused an uproar from the general public comprising all races and religions.

The judiciary as a whole play a pivotal role in the administration of any country. Our judges, barring a few like Sri Ram, went into a long slumber for over 20 years during the regime of Dr Mahathir Mohamad. How many are awake now and are doing a good job in the eyes of the

public and the international community whose opinion and assessment of the country are vital for our own economic growth and stability?

The irony is that judges cannot defend themselves when they deliver judgments for strong ethical reasons. Therefore, lawyers of the litigants should properly advice their clients accordingly.

Finally, let Sri Ram be elevated to the Federal Court as soon as possible. Withholding his promotion for so long is bad taste in the eyes of the public and international community with the matter even being raised in Parliament recently. He has written some of the classical judgments in the country and many of his apprentices have reached the apex long ago. It is a shame on us for this treatment delivered on him.
