I refer to Malaysiakini report Explosive revelations against Lingam .
After reading what GN Jayanthi has to say about the ACA’s investigations, I can now understand the shoddy investigation conducted by Chuah Lay Choo and her team. I am sure and I am correct to surmise that she was instructed not only to close one eye, but to behave like a bungling moron in her investigations.
What would you expect when a person like Muhammad Shafee Abdullah, a senior lawyer, a former a deputy public prosecutor and a Suhakam member accompanies Jayanthi to lodge a report with the Anti-Corruption Agency? You would, of course, expect immediate action by the ACA.
But yesterday we heard that even the ACA are scared because ‘‘too many high profile officials were involved’. On top of that, Jayanthi was given RM3,000/- cash.
Juxtapose the two sentences above and the irresistible conclusion any right-thinking person will come to is that the ACA themselves are involved in corruption. For RM3,000, they would have expected Jayanthi to keep her mouth shut as they (the ACA) had been told that have to close the case.
Who do you think has the power to stop an ACA investigation? The answer is in the structure of the ACA hierarchy itself - it is part of the Prime Minister’s Department so, of course, their ultimate boss can make the final call.
The ACA must be closed down and all their personal be seconded to the Royal Malaysian Police where I am sure they will be at home with their brothers there.
All said and done, the Anti-Corruption Act has to be seriously amended. I suggest that the Act be amended to empower the King to appoint an independent commission and that they report to no one else but the King. Just like the Independent Commission for Anti Corruption (ICAC) in Hong Kong when they were under British rule.
Under the current Anti-Corruption Act’s Section 3(2), the ACA director is appointed by the King ‘at the advice of the prime minister". Today we see from Jayanthi’s testimony that the ACA is not independent and is under the control of a greater power. We therefore question the prime minister’s ‘advice’ and his ‘choice’ of candidate.
Finally if RM3,000 is the best the ACA can whip up to keep Jayanthi quiet, it is really pathetic. I am sure the pasar malam VCD vendors can teach them a thing or two in this fine art of ‘taking care of people’
