Lawyers for Anwar Ibrahim said that they have not received any application to set aside the subpoenas issued to premier Najib Abdul Razak and his wife Rosmah Mansor.

"We have been told that Najib and Rosmah will come when required. They were supposed to be here on Monday but they were not," he said.

Asked if there was any application before the court to set aside the subpoenas, Sankara said there wasn't.

In the first sodomy trial and abuse of power trial in 1998, subpoenas were issued to then premier Dr Mahathir Mohamad but the statesman appointed lawyers to set them aside.

Anwar has maintained there was a political conspiracy to bring him down with this second sodomy charge as complainant Mohd Saiful Bukhari Azlan had met Najib two days before the alleged incident.

The politician is charged with sodomising Saiful at the Desa Damansara condominium between 3:01pm and 4.30pm on June 26, 2008.

Saiful met Najib at his official residence. Initially Najib denied such a meeting took place but admitted it later when pressured by reporters.

NONE Najib ( right ) and Rosmah attended an interview with Anwar's lawyers earlier this month to the surprise of many and said they did not want to be defence witnesses and did not want to be interviewed.

However there is a possibility that Najib and Rosmah will testify after the Hari Raya holidays. Tomorrow's witness will be DNA specialist Dr Brian McDonald.

Fourth witness

In court, Pusrawi Hospital Pusrawi administration manager Yusni Ali was called as the fourth witness and was questioned by lead counsel Karpal Singh on Saiful's medical report.

Opening the file, he said he only has a copy of the report which was kept in the general manager's office.

Karpal: Is this the original?

Yusni: This is a copy.

Yusni said he did not know where the original was, saying "that is what we have".

Karpal said the original could have been kept by the police and he will call investigating officer Supt Jude Blacious Pereira to clarify later.

Najib's former aide de camp and former Malacca police chief Mohd Rodwan Mohd Yusof was in the witness room as he had been summoned as a defence witness but was not called.

Former IGP Musa Hassan was also called but was not present today.
