The paradox in Anwar's sodomy trial

YOURSAY 'The prosecution is having its cake and eating it, too - not having to prove force and a cooperative witness to testify against the defendant.'

Pusrawi doc 'demolishes' Saiful's testimony

your say Kgen: In the first place, only in Bolehland can a rape trial proceed with the victim claiming he was forced and the defendant charged for consensual sex.

This is an injustice to the defendant. By charging Anwar for consensual sex, the prosecution does not have to prove how a 62-year-old man can overpower a strong youth. But if the act was consensual, the prosecution should not have a cooperative witness on their side.

Hence the prosecution is having its cake and eating it, too - not having to prove force and a cooperative witness to testify against the defendant.

This paradox should not occur in a real court, but of course this is not a real court.

Micheal: The verdict was perhaps written even before the case was heard in court. The entire proceeding is done with the intention to show some idiotic Malaysians that Opposition Leader Anwar Ibrahim was given a chance to defend himself in the court, even though the trial has been blatantly unfair to him.

He can only be found guilty if he is proven so in court, without any reasonable doubt. There are however too many 'doubts' - technically and medically - raised in the trial.

I hope Pakatan Rakyat is well-prepared to 'lose' Anwar as the rakyat are ready for change.

MfM: When then PM Dr Mahathir Mohamad had Anwar arrested in 1998 it backfired on him badly in the 1999 general election, which ultimately led to his resignation as PM.

PM Najib Razak hasn't learned from history and is repeating Dr M's mistake. He is underestimating the resolve of the electorate. All the better for Pakatan to finally put the final nail in BN's coffin.

Versey: This trial is a mockery of justice whereby the judge has decided the verdict before it begins. Malaysia's judiciary is again the laughing stock of the world.

I wonder how foreign diplomats, especially those from the Western world, could stand this kind of injustice if they are sincere about their preaching of human rights and justice.

If these countries can close their eyes and fold their arms when a prominent opposition leader in a supposedly democratic country can be so unfairly defamed and treated by the ruling regime, please in future, don't preach about human rights to countries like China.

Dev: Love the defence lawyers. Superb. Any fair court would throw out the case in an instance. But noooooo... not our kangaroo court.

Arbeena: DSAI (Anwar), it looks like you have no chance of entering Putrajaya. Try again next time.

Cascara: According to the prosecution, orthopaedic surgeon Dr Thomas Hoogland, DNA expert Dr Brian McDonald, Hospital Pusrawi doctor Dr Mohd Osman Abdul Hamid, Mohd Saiful Bukhari Azlan's college mate Mohd Najwan Halimi and Anwar's statement from the dock are all not credible. Only Saiful's tale is credible.

How incredible!

Anwar's Sodomy II verdict on Jan 9

Md Imraz Muhd Ikhbal: In accordance with the laws of most countries in the world, including that of Malaysia, incriminating evidence adduced must be beyond reasonable doubt and not on mere balance of probabilities for anyone charged of a crime to be convicted of it.

Having followed the case ever so closely since Day 1, notwithstanding all the so-called ‘evidence' the prosecution have presented, in no way have they dispelled all the glaring doubts that have been presented by the defence as to whether the crime even took place in the first instance.

It is, therefore, impossible by any rule of law to convict Anwar but by the perverse system of injustice under a draconian rule that knows no boundary of integrity or morality, it takes no Einstein to predict with precision that a conviction is imminent in the kangaroo courts of this blessed land.

That which remains to be unfolded is the masterpiece concoction of nonsensical arguments to support this perverse judicial ruling forthcoming this Jan 9.

Docs: Although I strongly think Anwar is not guilty and is being set up, I'm glad that Anwar will been handed the widely expected guilty verdict by justice Mohamad Abidin Mohd Diah.

Anwar behind bars may serve the greater good of the nation which I hope will be the spark that will change the hearts and minds of all Malaysians to cease supporting the BN.

Hopefully, the events in January will eventually lead to the ouster of the Umno-BN regime. The Arab Spring started in January 2011. Let's see what's in store for Malaysia come January 2012.

Pants on Fire: Correct me if I am wrong, this is the fastest ever date given for a verdict after the submissions on such a high-profile case. It normally would take months, but in this case, no less than a month, 25 days to be exact.

I wonder why. Hope it's not a quickie, judge. You have to answer to Allah at the end of it all.

1Mess: Expect GE13 soon after Jan 9 when Anwar is jailed. We, the rakyat, will show them who's the boss!
