Only one MB candidate has majority support

Kim Quek: Why the necessity to ask for nomination when the palace has already acknowledged receipt from PKR the affidavits from 29 Aduns from PKR, DAP and PAS affirming their support to Wan Azizah Wan Ismail as the MB?

 

Shouldn’t the sultan have granted Wan Azizah an audience instead to satisfy himself that she does indeed have the majority support in the assembly?

 

Once that is done, the sultan should simply appoint her as MB without further ado. Shouldn’t that be the orthodox process for the appointment of an MB in accordance with the constitution?

 

Odin: Prof Abdul Aziz Bari said that the only role of the Selangor palace (or, in general, the head of a state) was to appoint whoever had majority support in the House. Obviously, that is according to the state constitution.

 

The appointment is a mere formality, an act to grant the sultan or head of state some measure of importance. We seem to have here an adherence not to the state constitution but to the state constipation.

 

Pahatian: The constitution says that the candidate must be the one with the support of the majority. To date only one candidate and that is, Wan Azizah, that satisfies the condition.

 

Any other names will be considered irrelevant. So why the insistence and then contradicts the constitution?

 

Hang Babeuf: “(Selangor sultan’s private secretary) Mohammad Munir (Bani), meanwhile, said that the requirement for the parties to submit more than two names was so that it would be easier for the sultan to come to a decision” ... and to hell with the proprieties of “constitutional monarchy”.

 

While claiming to uphold, respect and adhere to “constitutional monarchy”, we want instead, he implies, to have a “constitutionally empowered monarchy” (that is, a monarchy of clear, definite, and autonomous/independent - though not entirely unlimited - powers), and this is part of the “royalist” game-plan.

 

The current Selangor impasse/imbroglio offers a moment of great opportunity to the royalist cause. It is a crisis, and as the grim wisdom holds, if you are given one, “never waste a crisis”.

 

RZC: Stick to the one name. It is the majority choice and the constitution is clear that the majority choice must become MB. Why should PKR give in to the intention to change or usurp the constitution?

 

I salute them as in this whole saga, DAP and PKR have been consistent and honest. PAS and outgoing MB Khalid Ibrahim do not deserve any salute.

 

Waktamnoko: Pakatan has their legal advisors and so does HRH (His Royal Highness). Who is to say that HRH has not acted within his legal powers as defined under the constitution? 

 

What makes Pakatan think that their legal advisors were the only ones qualified to interpret the constitution?

 

Anonymous_3f4b: Indeed, why is it so difficult for the Pakatan parties to nominate two names each for the sultan’s consideration? Is it because they have some ulterior motive in proposing only one name?

 

Both DAP and PKR cannot deny that they lack suitable candidates for the MB post and keep insisting on one name as this will bring about confrontation with the royal institution.

 

Rick Teo: The rakyat elect their state assemblypersons and the Aduns elect the MB. That is based on our state constitution and convention. The sultan, as pointed by legal experts, has no power to request any extra names.

 

The person who is the candidate for the MB’s post must satisfy the criteria that he or she has majority support. Wan Azizah has already shown her majority support .

 

The sultan has to appoint Azizah. There is no need to submit any other names.

 

Pemerhati: When commenting on Umno’s power grab in Perak with the help of the sultan and the many court cases, Aziz Bari had said that the judges turned the ‘law upside down’ to come up with ridiculous decisions.

 

In the case of Selangor, we are now witnessing that the ‘constitution is being turned upside down’ by the sultan to prevent Azizah from becoming the MB.

 

The unfortunate reality in Malaysia is that Umno has dictatorial powers and they can do anything they like by getting the public service, the enforcement agencies, the judiciary and the royalty to do its bidding, even if it is illegal and unconstitutional.

           

Fair Play: This is a speculative comment. What happen if PKR and DAP jointly make a press announcement that PAS is no longer a member of Pakatan?

 

And what happen if the two PAS assemblypersons who signed the SDs (statutory declarations) declaring their support for Wan Azizah resign from PAS and declare themselves as independent but PKR-DAP friendly?

 

And what happen if Wan Azizah again seeks an audience with HRH Sultan of Selangor? Would a snap election be the final outcome?

 

Anonymous_1388755032: Pakatan, please don't waste time for another week and submit Wan Azizah's name alone to HRH by tomorrow so that we can end this circus once and for all.

There is no need to wait until next Wednesday as the decision has already been made.
