The family of murdered Mongolian national Altantuya Shaariibuu filed an RM100 million civil suit this morning against the Malaysian government and the trio charged with the crime.

The suit was filed at the Shah Alam High Court through the family's lawyer, Karpal Singh. It cited Altantuya's parents Dr Shaariibuu Setev ( photo ), Altansetseg Sanjaaand and their granchildren Mungunshagai Bayarjargal (aged 9) and Altanshagai Munkhthulga (4) as plaintiffs.

They named chief inspector Azilah Hadri, 31, corporal Sirul Azhar Umar, 36, political analyst Abdul Razak Baginda, 47, and the Malaysian government as respondents.

The family is claiming compensatory, exemplary and aggravated damages for mental shock and psychological trauma caused to them.

The suit listed several particulars giving rise to aggravated and exemplary damages to include the fact that she was shot twice in the head twice and that her body was blown to pieces.

"The brutal and barbaric manner in which the deceased was murdered and her body blown up by C4 explosives available only at the behest of the high authority in Ministry of Defence and Royal Malaysian Police (RMP) as they were Special Forces Unit," it read.

"(All three accused in the murder trial) have in all circumstances acted in a high handed, oppressive and arbitrary manner."

The family is suing the Malaysian government because Sirul and Azilah were at material times acting agents and/or servants of the government, and because they had acted unconstitutionally in abusing the trust reposed in them as officers of the police force and government.

Loss of love

The family asked for RM6,000 a month as maintenance to cover education, food, clothing and medical expenses for Altantuya's two sons.

They are also asking for medical expenses incurred by Altantuya's youngest son, Altanshagai, amounting to RM36,000 for treatment in a Beijing Hospital.

The suit states that the family has suffered material losses and the children even more so as they have lost their mother's love.

"This position is further compounded by the fact that Altanshagai is disabled and requires constant medical care," read the statement.

Altantuya, a 28-year-old Mongolian national, is believed to have been killed in a jungle in Puncak Alam, Shah Alam last October. Only fragments her bones were recovered.

The case was scheduled to continue for a month beginning today but a 14-day postponement has been granted after a new prosecution team asked for more time to go through the documents.

Azilah and Sirul are charged with committing the murder in Mukim Bukit Raja, Selangor, between 10pm on Oct 19 and 1am on Oct 20 last year.

Razak is accused of abetting them, allegedly committing the offence at the Bangunan Getah Asli in Jalan Ampang, Kuala Lumpur, between 9.54am and 11.05am on Oct 18 last year.

If convicted, all three face the death penalty.
