A lawyer for Khaeryll Benjamin Ibrahim @ Benjy has filed a habeas corpus application at the Kuala Lumpur High Court registry, calling his detention order unlawful.

amer hamzah arshad interview 261005 up close The case came up for first mention today, and the actor’s lawyer, Amer Hamzah Arshad ( right ), said he submitted the application after a magistrate granted him permission to meet his client for 30 minutes to affirm an affidavit for the filing.

The case was fixed for second mention on May 12.

Benjy, who is the son of noted actress Azean Irdawaty, is detained under Section 3 of the Dangerous Drugs Act (Special Preventive Measures) 1985.  He is presently being held at the Bukit Jalil remand centre.

The actor was re-arrested on March 25, just minutes after being freed on a RM2,000 bail with one surety.

He was charged with possession of 0.24g of methamphetamine (syabu).

NONE When asked about Benjy’s ( left ) possible detention in Simpang Renggam or elsewhere, Amer Hamzah said that should this happen, he would definitely file another habeas corpus application.

Meanwhile Suhakam want to meet the actor and discuss matters involving his detention this Monday but its commissioner N Siva Subramaniam said this had yet to be confirmed.

Earlier this week, human rights organisation, Suaram had submitted a memorandum to Suhakam, condemning Benjy's re-arrest and the denial of legal access.
