The Aminulrasyid Amzah shooting trial has been postponed to next week, to give the prosecution enough time to complete its submission.

Deputy public prosecutor Mohd Dusuki Mokhtar requested for the adjournment as he had to attend an afternoon meeting.

Fellow DPP, Idham Abdul Ghani, who presented part of their submission earlier this morning, noted that he will need another two to three hours to complete their arguments.

NONE Earlier, lawyers defending the accused Korperal Jenain Subi ( left ), submitted that the prosecution had failed to prove beyond reasonable doubt that Jenain had indeed shot Aminulrasyid with intent to kill.

Defense counsel M Athimulan pointed out that the prosecution has been unable to present "credible evidence" to show without a doubt that the fatal bullet had indeed come from Jenain's sub-machine gun.

"We do not dispute the death or the cause of death. The issue is, who caused the death?"

Athimulan stressed that the prosecution had only relied on circumstantial evidence and witnesses' accounts, none of which are sufficient grounds to prove that Jenain had fired the fatal shot nor proved that he had intentionally aimed at the occupants of the white Proton Iswara driven by Aminulrasyid.

'Unfortunate, but not wrong'

Athimulan said Jenain's decision to shoot at Aminulrasyid's car was justifiable as the driver's dangerous conduct on the road was a clear threat to the safety of the police officers in pursuit as well as the public.

"The evidence shows the unusual conduct of the driver, and an experienced police officer would conclude that there was reason to believe that it could be related to some criminal activity.

"The death is unfortunate... But this is not a case of indiscriminate shooting," he said.

Sessions court judge Latifah Mohd Tahar adjourned hearing to Monday (Jan 31).
