Witness: PNSB board rejected Shamsuddin's appeal

The PBSB board was chaired by then Selangor MB Dr Mohd Khir Toyo
Mohd Nizam said this while being cross-examined by lead defence counsel M Athimulan on the 10th day of Khir’s corruption trial.
He agreed with the lawyer that PNSB's day-to-day management and decisions on projects are handled by a chief executive officer appointed by the board.
Athimulan posited that the board will reject applications if it does not conform to PNSB requirements, to which Mohd Nizam agreed.
The company secretary also agreed to Athimulan’s proposal that in his view, the company board and management are professionals who will act professionally.
However, he disagreed when the defence counsel argued that the board, which had appointed the CEO, will then no longer intervene in project management.
Mohd Nizam answered that the board of directors chaired by Khir can intervene should there be any changes.
The company secretary, during examination-in-chief by DPP Masri Mohd Daud earlier, had confirmed information recorded in company documents that PNSB had awarded Bidara Lumayan a contract to jointly develop a piece of state land in Sungai Long, Cheras.
‘Majority agreed by signing the document’
The award, made after considering tender proposals from three companies, was decided upon by the board via a directors’ circular resolution, without being referred to a full board meeting, though the directors were informed individually and the majority agreed by signing the document.
Several more witnesses were called after Mohd Nizam to verify more documents.
The final prosecution witness, MACC officer investigating the case Chang Cheng (left) , took the stand and described how he came to investigate the case and the documents he seized and actions he took to obtain the facts and evidence of the case.
The court then broke for lunch, after which the investigator will continue his testimony.
