DAP parliamentary leader Lim Kit Siang urged the Attorney-general Abdul Gani Patail and the Malaysian Anti-corruption Commission (MACC) to explain why no action has been taken against its three MACC officers despite the royal commission of inquiry (RCI) holding them responsible for the death of political aide Teoh Beng Hock.

NONE They are former Selangor MACC deputy director Hishamuddin Hashim ( left ) and two of his enforcement officers Arman Alies and Mohd Ashraf Mohd Yunus who were involved in interrogating Teoh.

The veteran politician said it is clear that the commission, in its report, agreed that MACC and its officers were clearly responsible for the death through the aggressive, relentless, oppressive and unscrupulous interrogation .

However, Lim also slammed the commission for failing to clearly and unmistakably state in the report's conclusion that MACC and its officers were responsible for Teoh's death.

NONE He quoted paragraph 119 of the RCI report which reads: "Having considered all the evidence in its entirety, we found that Teoh was driven to commit suicide by the aggressive, relentless, oppressive and unscrupulous interrogation to which he was subjected by certain officers of the MACC who were involved in the ongoing operation by the Selangor MACC on the night of the 15th and into the morning of the 16th".

On top of that, Lim (right ) pointed out that paragraph 198 and 201 again showed that the commission is quite unanimous about who the MACC officers that caused Teoh's death.

"But the question is why the commission did not specifically name these 'MACC officers responsible for Teoh's death' and spoke instead about 'forced suicide'?" he asked in a statement issued today.

Manipulative bully tag handed out

He said paragraph 225 had indicated the identities of the three MACC officers responsible for the death - Hishamuddin, Arman and Ashraf.

NONE The report respectively described the three as the 'arrogant leader ', who would have no qualms in lying so long as his ends were achieved, regardless of the means employed, the 'bully' who would manipulate his witness to obtain evidence, and the 'abuser' who was Machiavellian in his method to secure evidence.

"The Attorney-general and MACC should explain why the three officers have not been suspended and no criminal charges and departmental disciplinary action taken against them," queried Lim.

Besides causing Teoh's death through unlawful misconduct, the Ipoh Timor MP commented that the MACC and its officers had committed perjury, except for Azeen Hafees Jamaluddin and Azian Umar who exposed Hishamuddin's falsehoods during the inquiry.

NONE "The commission has virtually dismissed the whole cast of MACC witnesses at the inquiry except for two, Azeem and Azian, as liars, meaning they had all committed perjury.

"Section 193 of Penal Code prescribes seven years jail and fine for giving false evidence at judicial proceeding like the inquiry. Will the whole lot of MACC witnesses be charged for perjury at the inquiry?" he asked.

Both the MACC and Minister in the Prime Minister's Department Mohd Nazri Aziz ( above ) had pledged that appropriate action would be taken against the officers involved, and on the findings and recommendations of the commission.
