MCA must sever ties with Umno if the latter endorses the Kelantan state government's move to implement hudud law, said party leader Gan Peng Sieu.

"If Umno endorses the Bill at the federal or parliament level, it constitutes breaking the fundamentals of the nation, nation building and social contract," he added.

Gan, who is the chairperson of MCA’s syariah law and policy implementation special task force, said such a scenario would compel MCA to act.

"If I have the say, I would invite other component parties to break away from Umno (as well)," he told a press conference.

MCA has strongly objected to the hudud law to the extent that it considered quitting the ruling coalition when the Terengganu BN government expressed its intent to implement hudud in the state five years ago.

Gan said his party had a duty to raise the issue as all the twelve Umno state assemblypersons in the Kelantan state assembly had supported the hudud bill when the amendment to the Syariah Criminal Code Enactment II 1993 was tabled earlier today.

"When 85 percent of the Chinese voters listened to the lies that PAS has abandoned their theocratic ambitions, now BN has to deal with it.

"Some of the Umno legislators argued that if 85 percent of the non-Muslim voters are prepared to support PAS, what's wrong with them going along the same lines?" he asked.

Hudud nationwide possible

Gan was refering to 2013 general election results when as high as 85 percent of the Chinese electorate voted for Pakatan Rakyat.

He also took DAP to task for failing to stop its 'best friend' PAS from tabling the bill and he went on to describe today as ‘the darkest day’ in Malaysian political history.

MCA, Gan revealed, may ask the courts to declare the hudud bill as unconstitutional particularly as he claimed it was against Article 5 and Article 8 of the federal constitution.

He said research by the party's task force showed the federal constitution need not be amended to allow Kelantan to pass hudud law.

This can be done by amending the current state syariah law in Parliament to allow the syariah courts a wider jurisdiction in imposing syariah law and its punishments.

Gan said syariah law could also be implemented nationwide by amending the Penal Code and having Parliament to pass it by a simple majority.
