On Monday, Justice Abdul Aziz Abd Rahim proclaimed that Nizar is the rightful Chief Minister.

The next morning at 11.45 am Justice Ramily Mohd Ali - without his panel - sits at the Palace of Justice in Putrajaya, to hear an application by Zambry Abd Kadir and grants a stay.

How and for what reasons, was the appeals court constituted to hear Zambry's application

within less than 24 hours after the high court made the proclamation that Nizar is the

rightful chief minister?

This unfolding situation prompted me to look into the ‘ Justinian Code'(Byzantine Empire, 534 CE) on the ‘rule of law'. In ‘Book 1 Of Persons' it refers to justice and law. What it states is this:

‘ Justice is the constant and perpetual wish to render every one his due' and it goes on to state that, ‘jurisprudence is the knowledge of things divine and human, the science of the just and the unjust.'

The reader may be wondering, what has the Justinian Code got to do with the Nizar - Zambry case. It is pure and simple. The politicians in Perak with Najib's unethical acts and conduct are not able to serve the people who in the first place put then in power. The ruler has failed to uphold the constitution.

The lawyers can forever keep on filing applications over applications, to keep the courts making one proclamation over another, and file one appeal over the other, with no end in sight.

So, the question is, when are the people of Perak who voted these politicians into power, ever going to obtain the justice that is due to them by these politicians serving the people's cause?

Here I call to mind what the late John F Kennedy said: ‘Civility is not a sign of weakness, sincerity is subject to proof. Let us not fear to negotiate, but let us not negotiate out of fear'.

When I refer to the Justinian Code and to what the late Kennedy said, I am prompted to ask Najib as to why he and his henchmen are so much afraid to face and negotiate with the people of Perak in a civil manner, by calling for a election.

Could it be that all this while Najib and his henchmen were following the ‘principle' of what was stated by Charles Muarice De Tallyrand, which is, ‘Speech has been given to man to disguise his thoughts"?

And Najib, you and your henchmen now painfully have come to the realisation that the Malaysian people are no longer naive and can read in between the lines on what you and your henchmen state or promise and the people no longer trust the Barisan Nasional?

If that is the case, Najib, you have exhausted all the illusions manufactured by BN and why do you not have the courage to face the reality that your era is coming to an end?

Remember what the late Winston Churchill said, ‘Courage is the first of human qualities, because it is the quality that determines all the others.'

Have the courage and face the people in Perak by calling for an election.
