I refer to Malaysiakini report Evicted speaker cries 'conspiracy!'
Watching the footage of how Speaker V Sivakumar was unceremoniously bundled out from the August (is it still august?) assembly hall shocked me. Those police officers looked like a bunch of bouncers in the bar roughing up some one. One word that aptly describes their behaviour: downright disgusting.
Coming to events leading up to Sivakumar's eviction, I have a few questions to ponder upon.
Right at the begining of the assembly, Zambry Abdul Kadir and Hee Jit Fong were ordered out from the hall.
Of course, they stubbornly remain rooted to their seats. In this situation, the sergeant-at-arms should have come to escort those few out of the hall. Why didn't they follow their orders?
Even though Zambry and Hee Jit Fong still remained in the hall, technically and legally they were expelled. But BN seized the opportunity to grab the speaker's chair and hastily appointed R Ganesan as the new speaker.
My question is, can Hee Yit Fong, technically expelled from the assembly hall, act as a member of the assembly? In football, if you were to field a suspended player, not only the defending team forfeits the match but would be punished with a fine as well.
Maybe I am only dreaming. This is Malaysia and anything goes as long as BN can hold on to power. Another mind-boggling issue is the involvement of the police in evicting Sivakumar. The IGP has said clearly before this that the police have no 'jurisdiction' in an assembly hall or in Parliament.
That is the reason why those Umno mobsters who confronted Karpal Singh are still free from charges. But in the Perak assembly case, those policemen in plainclothes were clearly prepared for action - to drag Sivakumar out. Tell me IGP, which is the correct?
IGP, if you cannot enforce the law fairly, please do away with it. Also it was reported that Hee Yit Fong tore a curreny note in the dewan. Such an act is insulting to the nation. The note has the portrait of our first beloved Agong and it is there not without a reason.
It symbolises the integrity and sovereignty of the nation. Isn't the tearing of the note an act of disrespect towards the monarchy and the country? In some countries, such an act would land the culprit in jail. Will Umno Youth come out to protest Hee's action?
Oh, maybe Article 72 of the federal constitution applies. Whatever dastardly action in the asembly hall is no business of the police and the judiciary.
Coming to the question of legitimacy of Ganesan's position as speaker, was he rightfully and legally appointed?
We must bear in mind that Hee Yit Fong is suspended. Can a suspended member be present in the assembly? If not, Sivakumar is still the speaker of the house.
Can Pakatan challenge the appoint of Ganesan in the court? On second thoughts, I think it would be an act in futility.
