We refer to the above matter and our media statement dated Sept 9, 2014. 

We write to clarify that the article is incorrect as our statement does not in any way say Bank Islam does not want the details to be made public.

The statement reads "As TSKI’s lawyers, we are aware of the terms of the settlement, but the terms were intended to be confidential between the parties and that any specific disclosures of the terms must be with the consent of BIMB which we do not have."

 

What was actually stated in our media statement is that without the consent of Bank Islam, our client (Tan Sri Khalid Ibrahim) cannot reveal the details of the settlement.

We have written to Bank Islam’s solicitors to seek consent but we have not received a reply as yet.

 

Mr Derek Fernandez is not a member of the firm. The phrase "We" used in the media statement refers to the firm (Thomas Philip).

Mr Fernandez is also not involved in the said settlement with Bank Islam. He is representing Tan Sri Khalid Ibrahim in two other cases involving the same parties.
