LETTER | The choice of the attorney-general is the prerogative of the sitting prime minister. This is clear in our constitution. And in the same breath, the position of our monarchy is enshrined and safeguarded in our system of parliamentary democracy. The constitution is supreme for rule of law to thrive.

The PM being unique and unequalled in his experience in appointing four AGs before during his previous stint as our fourth pm, is now on the verge of appointing the fourth in his second tenure as our seventh premier. There is enough wisdom depicted in these numbers for our 92-year-old fighter!

He is aware that the people have had enough of how injustices have enveloped us in such a magnitude that it has affected the very fabric of our socio-economic well-being.

From the courts to the cash hoarders; 'enough is enough' is the roll call talk in all discussions be it amongst the young or the old. The call is loud and clear and it would be prudent for all in the political spectrum to take heed.

The AG's office is the backbone of the criminal justice system and the investigation arm is totally dependent and subservient to it. The totality in the discretion of prosecution by the AG and the fusion of powers of these two limbs makes him a very powerful player in our justice system.

But we have had enough of the miscarriages of justice, the poor prosecution strategy in the Altantuya case, the fiasco of how our two most prominent investigative arms being the police and the MACC were at loggerheads as the AG's chambers remained silent; just to name a few prominent ones that come to mind.

Be it either incompetence or by design, society had to put up with it until the dams burst at GE14. The inept handling of the 1MDB's investigations was part of the last straw that broke the camel's back. The perpetrators finally will face the legal consequences and it will sink it only when they hear the clanging of the prison gates close behind them.

The current AG, too, may be criminally liable as the legal pundits debate that aspect of the law although I am of the opinion that it was the intention of the law to make the AG immune to prosecution.

The question of bona fide or mala fide will be the key points of argument. Nevertheless, the spirit of the law is no match for the will of society as history has shown time and time again. Crooks never learn!

The PM should be given the chance to set the house in order and we have to go with his choice of who becomes AG. It is also opined that he should go one step further in making both the custodians of investigation and the prosecution accountable to Parliament and this includes the manner of their appointments.
