From KSY letter ( Islamic state - Mahathir was right ), I presume he is saying that laws established upon Islamic principles are against human rights and common sensibilities. Islam guarantees the right to freedom of religion without compulsion. The lack of understanding of syariah and its wisdom shall not be used by the those who misunderstood Islam to bash the relevancy of Islamic principles in the judiciary system.

I am not saying that what the Syariah Court did in the M Moorthy case was right, but as a Muslim, I take umbrage at any attempt of secular opinion shapers to take advantage of an incidental flaw in our judicial system by discrediting Islamic principles' applicability in the court of public opinion where not a single scholar, who is an expert in Islam, is consulted.

I believe most Islamic scholars who represent the practicing Muslim community in this country will consider the judicial process that led to the Syariah Court decision as something that should have been avoided. The criteria used in making the decision - whether the deceased was a Hindu or Muslim at the time of death - should be thoroughly analysed and its rationale must be made transparent to the public.

Things should have been better if the deceased family members had been informed of the deceased conversion to Islam earlier (not when the deceased is in a coma, incapable of articulating his belief to others).

Public opinion shapers should push for steps to clear the ambiguity of jurisdiction of religious and secular courts, not raising fearful sentiments of the wrongfully perceived 'Islamic state' and definitely not by disrespectfully making mockery of Islam's universal justice and its role in the constitution.
