AG: Delay due to thorough probe

Not Confused: It is heart-warming to know that the Malaysian Anti-Corruption Commission (MACC) and attorney-general have carried out a thorough investigation. Hopefully it will lead to a solid prosecution case and will not be thrown out on a technicality. If it is, then the MACC and AG himself will have lots of eggs on their face.

Now, what about all the other dozens of similar corruption cases brought to light in the past few years - including Abdul Taib Mahmud. There must be boxes of solid evidence as revealed by the Sarawak Report over recent months.

Sincere citizen: Attorney-general Abdul Gani Patail said the lengthy delay in prosecuting former Selangor Menteri Besar Dr Mohd Khir Toyo over his lavish Shah Alam mansion was because a very thorough probe had to be conducted.

If that mansion belonged to Opposition Leader Anwar Ibrahim, I think he would have been in lock-up long ago.

KJ John: AG, I will believe all your stories including the " ilham you may have received to finally make the charge" when you were out of the country. Just please make this one sticks for the sake of all Selangorians who have seen this crooked fellow abuse the state and its resources.

Otherwise, can you do all of us a favour and resign please?

KSS: AG, the delay really shows that you and your office are incompetent for taking such a long time to investigate such a glaring masterpiece of corruption. If you did this in the Singaporean jurisdiction - you and your cohorts would have been sacked a long, long time ago.

Gen2: The authorities had to do a ‘thorough investigation' to find out where the Khir Toyo can escape due to some technicalities in the law. Turn right, cannot find any excuse. Turn left, cannot find any excuse.

So finally, they found the most lenient law to charge him with. Remember, Teoh Beng Hock died for only RM2,400.

Gordon Gecko: AG, so far, your major ‘probe' that saw success was the prosecution of Anwar Ibrahim 10 years ago. And I believe, you will definitely score a second victory on the same victim in months to come.

But as for the other corruption cases, your catches have been dismal and it's ‘ikan bilis' (small fry) all the way. Come on, let's put some ‘shark fin', ‘soon hock' and ‘cod fish' on the table.

For me, Khir Toyo is akin to a barracuda - a trophy catch. But AG, will you purposely let it slip away like the others and again blame it on broken net?

Magnus: 1. "Asked why the two accused were not charged under the MACC Act, Abdul Gani said the offence proper was committed under the Penal Code."

So why did the MACC carry out the investigation and not the police and public prosecutor?

2. '"But our accusation is by virtue of the MACC Act. If you had listened earlier in court, I mentioned that this is a prescribed offence under the MACC Act and, by virtue of that, it becomes a seizeable offence.'"

I am confused now. What was the AG trying to say in No 1, and what was he trying to say in No 1?

3. "If it is only under the Penal Code, it becomes a summons case and you get a warrant of arrest, but we are using the MACC Act."

Help, now my brains are really frying...

Would it not have been easier/clearer for the AG to say that the accused was being investigated and charged under both the MACC Act and the relevant section of the Penal Code, so that if one charge failed to stand up in court then the other perhaps might succeed?

Habib RAK: If charged under MACC Act, the assets can be seized if corruption is prove. If charged under Penal Code, the maximum is only two years jail and a fine, or both. Why AG goes for Penal Code and not MACC Act?

Cala: It looks like the AG will be giving Khir Toyo a lot of discount.

Yuvan: It is a real pity that the AG thinks the people are so stupid and really believes that they will buy whatever he sells (sorry, whatever he tells...). He can take months and years to thoroughly probe BN politicians accused of graft and corruption. But he comes with lightning speed and is ever happy to take opposition politicians to court with the least bit of evidence and without any probe at all. What a great AG we have.

Patriot: Khir Toyo a former dentist managed to amassed such immense wealth in his short tenure as MB of Selangor. Surely that there are many other scandals involving him. If not why did he had to cart away lorry loads of documents from the Selangor government office in Shah Alam on the night of March 08, 2008?

The rather pathetic responses from the AG n MACC leaves a rather bad taste in all Malaysians and speaks volume of their so-called independence. Only a change of government will shake them out.

Pemerhati: Umno has been fooling Malaysians to get their votes in a very predictable manner. Dr Mahathir Mohamad removed the biggest threat to himself and his corrupt cronies by imprisoning Anwar on trumped up Sodomy I charges.

Just before the 2004 elections Umno fooled the public into thinking that it was serious about fighting corruption by charging two prominent people, a non-bumiputera and a bumiputera (Eric Chia and Kasitah Gaddam), for corruption. Most people at that time thought that it was all a charade and were proven correct when both were eventually found innocent.

Before the next elections we see an exact repeat of the previous despicable behaviour by Umno. Anwar is predicted to lose his case in the kangaroo court on trumped up Sodomy II charges and end up in prison before the elections.

And two VIPs (Dr Ling Liong Sik and Khir Toyo) have been charged and would probably be found innocent if BN again manages to fool the electorate and win the elections. It would be interesting to see what happens to them if Pakatan Rakyat wins.

Ghkok: I believe Khir Toyo's mansion was brought to the surface in the middle of 2009. So it took 18 months before he is charged ... and most people are wondering how long the trial would be.

And this is only one case. And while this case is going on, how many more cases of corruption will already have taken place?

Ferdtan: Khir Toyo is not relevant to Umno anymore and can be sacrificed. After his great downfall in losing Selangor to Pakatan, he tried to salvage his power by going for the post of Umno Youth head in 2008. The post was narrowly won by Khairy Jamaluddin against the earlier favourite, Mukhriz Mahathir due to the split in votes from Khir Toyo; thus earning the wrath from the Mahathir camp.

Since he was never in Najib's camp (forget about Pak Lah's camp - too insignificant), and with his enmity with the Mahathir's camp, we can see how easy it is to choose him to be the one to 'walk the plank'.

Nicole: He may walk the plank but he will not be made to go over it.
