The Shah Alam High Court has ordered Dr Mohd Khir Toyo to enter his defence in his corruption trial.

"The prosecution has made a prima facie case against him," Justice Mokhtaruddin Baki ruled this morning.

NONE Mohd Khir is charged under Section 165 of the Penal Code for alleged graft involving the purchase of two plots of land and a house in 2007 from company director Shamsuddin Hayroni (left) .

The property was said to have been sold lower than the market value, allegedly in exchange for considerations for Shamsuddin's companies in contracts with the state government and state GLCs.

Justice Mokhtaruddin said the prosecution has established three ingredients of the charge - that:

  • Mohd Khir was a civil servant at the time;
  • A valuable item, in this case, a mansion, had changed hands with inadequate compensation; and
  • There was a direct link between Mohd Khir and Shamsuddin in the conduct of official duties.
NONE The hearing is set to continue from Sept 26-30.

Khir ( left in photo ) appeared unperturbed and flashed his trademark smile when approached by reporters outside the court.

However, he refused to comment on the decision.

Mohd Khir had previously claimed that the transaction had been on a ‘willing buyer, willing seller’ basis.
