The Petaling Jaya City Council (MBPJ) has resolved to take the controversial transfer of its mayor, Mohamad Roslan Sakiman, to court for a judicial review.

The decision was unanimously reached at a special meeting yesterday, attended by all 24 city councillors.

NONE According to Malay daily Sinar Harian , the meeting agreed to establish a special committee led by councillor Khairul Anwar Ahmad Zainnuddin to take the matter to court.

Councillor Derek Fernandez told the newspaper that MBPJ would also write to the Public Service Department (PSD) seeking an explanation for the transfer of Roslan ( left ) despite the Selangor state government having just extended his contract as mayor.

"If PSD fails to provide a strong answer, this matter will be taken to court," Fernandez is quoted as saying.

He also revealed that an application would filed as soon as possible to seek the court's declaration that a city mayor is a state government appointee and hence cannot be transferred without the consent of the state.

"This is in line with Section 10 of the Local Government Act 1976, which clearly empowers the state government to appoint a mayor according to procedures under the current regulations," he explained.

NONE Fernandez ( right ), a lawyer by profession, also questioned the PSD for changing its 24-hour transfer order to Roslan to a notice of 30 days.

Earlier this month, Roslan was given a 24-hour notice by Putrajaya that he was being transferred to become Selangor deputy state secretary, a lateral position.

The sudden move surprised the state government, which said it was not consulted on the matter.

Some councillors see the sudden transfer of Roslan as an attempt by the BN federal government to destabilise the Pakatan Rakyat-ruled state government.

Selangor Menteri Besar Abdul Khalid Ibrahim then announced the freezing of the transfer order until the conclusion of discussions with the PSD.

However, the newly-appointed chief secretary to the government, Ali Hamsa, said Roslan's transfer would still go on , but that it would be delayed by a month.
