Lembah Pantai MP Nurul Izzah Anwar has become the second opposition MP to file for a judicial review on the electoral roll in her constituency, after finding over 4,000 suspect names on the electoral roll.

NONE Her lawyer, Edmund Bon (left) , said that the case has been filed on March 26 at the High Court, and that the applicants are expected to know the dates of the trial on April 1.

Nurul was joined by Kadir Sultan Abd Majid, a resident of Bangsar and a voter in Lembah Pantai.

They named the chief registrar of the Election Commission (EC), the Election Commission, the director of the National Registration Department, and the government of Malaysia as the respondents.

Bon said that unlike a similar review that was sought by Klang MP Charles Santiago before, which was struck out, his clients are seeking the review based on Section 25 (2g) of the Election (Registration of Voters) Regulations 2002.

According to this regulation, the chief registrar may at any time cancel any names from the electoral roll that he deems to be suspect.

Nurul has written a letter to the Election Commission about the suspect names on March 4, but said that no action has been taken to rectify the roll.

According to her, there are at least three voters who are dead, 133 who are non-residents, and 4,637 voters whose addresses are unspecified or incomplete.

“In Charles’ case, the court struck out his case based on Section 9A of the Elections Act 1958. But we are bringing up Section 25 (2g), something that has never been brought up in Malaysia before,” he said.

According to Section 9A of the Elections Act, the registration of voters cannot be challenged in court once the electoral roll is gazetted.

The rule was introduced shortly after residents from Likas challenged the presence of foreigners in the electoral roll for the Likas by-election in 2001.

Nurul said that EC has not rectified discrepancies in the electoral roll even though opposition MPs had raised the issue several times during meetings with the EC.

“Thus, we are left with no avenues except to seek a legal recourse,” she said, emphasising that the coming elections could be the most crucial one yet.

“It is not our (opposition MPs) job to find out doubtful names in the electoral roll. These are only numbers that we have managed to discover,  there could be thousands more,” she said.

“Even if we lodge a formal complaint in these voters and they are removed,  there are no guarantees they won’t return to the electorate by the time the election comes,” she added.

She said as if the third quarter of 2012, there were more than 71, 000 voters in Lembah Pantai,  a massive hike from over 58,000 voters who were registered for the 2008 elections.

If she is chosen to defend her seat, Nurul is widely expected to square off with Raja Nong Chik Raja Zainal Abidin, the current Federal Territories and Urban Well-Being Minister. 

'Nothing to add on sex video'

Nurul refused to comment on a claim that a “sex video” purportedly feauring her is currently in the works by Umno agents.

“I think Saifuddin (Nasution) has said all there is to be said. I have nothing to add,” she said curtly.

He said the videos do not appear to be convincing, claiming to have seen “teasers” of the videos.

DAP secretary-general Lim Guan Eng today condemned the creators of such videos to be "immoral and uncivilised".

"First it was the father and now the daughter who have become victims of such videos," he told a press conference.

Lim lamented that he, too, had been a target when certain quarters tried to involve his teenage son by accusing him of molesting his female schoolmate, which turned out to be baseless allegations.

"We are not involved in the scandals yet we got slandered by BN. They are willing to do this to cover up their own scandals. Do they think we are like them? We are not like them at all," he added.
