Chief justice should act against AG for contempt

YOURSAY ‘AG does not have any respect for judges in the appellate court.’

 

Court discharges Nik Nazmi from fresh charge

Ferdtan: If the chief justice dared not act against the attorney-general (AG) for contempt of court in the case concerning Selangor deputy speaker Nik Nazmi Nik Mat for instituting a frivolous charge, illegally charging him twice for the same offence, then he should sue AG Abdul Gani Patail.

 

Nik Nazmi’s second charge in the Session Court by AG’s Chambers was done in bad faith for the purpose of harassing him. He should bring the frivolous suit for damage for malicious prosecution.

 

Abdul Gani cannot escape the suit as recently in a landmark ruling by judicial commissioner Vazeer Alam Mydin Meera, the High Court has ruled that the country’s AG and public servants do not enjoy immunity from lawsuits involving allegations of power abuse.

 

The decision was made due to the suits brought about by former top police officer Ramli Yusuff and senior lawyer Rosli Dahlan.

 

Put Abdul Gani in his place and strike fear into him that he of all people should follow the laws that he is to safeguard.

 

IQ900: If the Court of Appeal decision takes precedent in the application for a judicial review in the use of ‘Allah’ in Sabah’s Sidang Injil Borneo (SIB) case, why is AG take a different stand in Nik Nazmi's case.

 

Moreover, it is only 11 days after the Court of Appeal ruling. Abdul Gani surely is applying double standard and therefore not fit to be AG. He should resign immediately, otherwise he should be sacked.

 

Worried Sick: What is wrong with our AG? Doesn't he have any respect for the judges in the appellate court?

 

Isn't he in contempt of their decision? Why is he not charged? We, the laymen, are baffled. This is a charade and the courts are being used for political motives. They shouldn't be.

 

Please politicians, leave the courts alone. Now, we seem to have an increasing number of judges who do not follow anyone's dictates but the law. This is as it should be. It bodes well for the future of the country. 

 

Mushiro: What is the AG up to? When common sense says the AG's re-charging of Nik Nazmi for the same charge is childish vengeance, yet the AG went ahead.

 

This has made a mockery and brought ridicule to the AG's office. I bet the Malaysian lawyers must be having a hearty laugh.

 

Relevancy: One can only wonder whether the AG knows the law of the country.

 

He was one of the architects who drafted the Peaceful Assembly Act (PAA) and yet, he does not know what it means and when to stop. A real shame.

 

Fair Play: Wow, Sessions Court judge Yasmin Abdul Razak just gave a lesson in Introductory Law 101 to the highest legal office of the government, the AG’s Chambers.

 

This no-brained AG thought that he could prefer charges as he pleases just because he is the AG.

 

Swipenter: Yasmin, you did the right. Even a layperson knows that you cannot be charged twice for the same offence. It looks like you know the law better than the AG.

 

Kim Quek: The chief legal adviser to the king and the government has turned into some kind of a nut? Wouldn't it be more appropriate for Abdul Gani to replace his AG's gown with Umno's robe?

 

Wira: Even the Session Court judge has more judicial common sense than the attorney-general who may one day become chief justice.

 

Donplaypuks: The AG has shown his stupidity and sheer incompetence by filing a double jeopardy case.

 

He cannot tender any excuse that he's ignorant of the law and legal precedent. He's the worst AG this country has ever had. He should resign or be sacked immediately.

 

He should also be fined double the amount the case cost for wasting the court's time and taxpayers' money.

 

Onyourtoes: I think we should charge the AG’s Chambers for contempt, abuse of power and wastage of court time and resources. 

 

Whoever initiated the recharge should be identified and prosecuted. It is time for the judiciary to stand up to uphold its constitutional role. 

 

RR: I can't understand why the AG is behaving so stupidly by recharging Nik Nazmi for the same offence and making himself  a laughing stock in the eyes of the world. It is a shame for him and Malaysia too.

 

Oh Ya?: The ruling elite are indeed very desperate. Lawyer cum MP N Surendran, please pursue them in Parliament and on the streets. Enough is enough. Malaysians must say no to this repressive and oppressive regime.

 

Haveagreatday: Wow! It looks like there are indeed gems in our judiciary who will rule on the merits of a case based on universal principles of fairness and justice.

 

AG, better sign on that legal ‘mercenary’ Muhammad Shafee Abdullah again.
