IGP to take 'middle path' in custody battles

Waktamnoko: Non-Muslims would want the IGP to enforce the law which favours them. The Muslims would want the syariah judgment to be enforced. Now, what do we want the IGP to do?

 

We have nearly 60 percent of the people who are Muslims in favour of the Syariah Court judgment and 40 percent who want anything against Islam to be enforced.

 

MfM: Haven't you heard? Malaysia is a Muslim country. Not secular. Former premier Dr Mahathir Mohamad declared this a long time ago. We're a member of the OIC; therefore a Muslim country.

 

Syariah and civil courts are separate. The inspector-general of police (IGP), pushed in a corner, has to take the middle way out. For once, he's making some sense.

 

The IGP like every other Muslim, is a Muslim first before all else. If you non-Muslims don't like the way Muslims think that Islam comes first all the time, too bad. As in all democracies, the majority rules.

 

Tholu: Hello IGP, who do you think you are? The police department is under the executive branch of the government and as such its duty is only to enforce the law passed by the legislature, one of the other government branches.

 

What Act of the land are you using in arriving to your decision to send the children to childcare centres? Don't you dare play the role of the legislature while also executing the law made unilaterally by you. 

 

You have already overridden the judgments of the courts and this makes you an offender in the eyes of the law since you are acting in contempt of the court, a punishable crime under the law.

 

The fact that you can now create and make your own law, enforce it and adjudicate it, all by yourself only goes to show how arrogant and dictatorial you have become.

 

And you couldn't be so bold to do all these if you do not have the solid backing of the religiously biased Umno government leaders. This is a gross abuse of power by the government, by the AG and by the police.

 

De facto law minister Nancy Shukri said : "To me, based on my reading, the police should take the kid away from the father and return (the child) to the mother. I think the court has been very fair in its decision."

 

Meanwhile, MIC president G Palanivel said : "It is extremely important to note that the country's legal system is credible and the government has responsibility to ensure that the stakeholders can be trusted to implement and enforce all court decisions without fear or favour.

 

“In this regard..., we seek the authorities to put this case to rest by ensuring Indira (Gandhi) gets her child soonest possible."

 

So, Nancy and Palanivel, is this action by the IGP a good reason why he had not acted on the case earlier? Are you happy with IGP’s decision?

 

My guess is you would not be. But alas, you are under the inviolable dictates of Umno and as servile and spineless non-Umno cabinet members, you are just going to keep silent and let Umno continue with its atrocities and injustice towards its non-Muslim population.   

 

FairMind: By placing the child in a childcare centre, the police is making that innocent child more or less an orphan without the love and care of either parents, not to mention who is going bear the costs.

 

Is that humane? This decision rightly belonged to the judge in a court of law. Is the police a law unto itself? Next time a judge sentences a person to jail, can the police decide to put him in a hotel?

 

Yahoo: Ask the IGP what happens to the child if the two courts take many years to settle the case. She would be an adult by then. There’s no parental guidance and love in a childcare centre.

 

Stig: So the IGP has created his own law; neither follows the syariah or civil court orders. But what about the welfare of the affected children?

 

Instead of being separated from their siblings due to police inaction, they will now be separated from both parents due to police action.

 

This just reinforces the need of an independent body like the IPCMC (Independent Police Complaints and Misconduct Commission).

 

Awakened: How low can our country and our IGP go? We can only have one law. It is just like you can only have one referee for any game.

 

Imagine we have two referees for a badminton game when one referee is from Japan and one from Malaysia.

 

How the international badminton association going to decide if both referees give different answers?

 

Pputeh: This must be a first in the world; a record of sorts for Malaysia, where the police in a secular country does not enforce the civil court’s ruling.

Dzulkefly Ahmad: So when did the IGP have power to decide rules and regulations on his own? What has attorney-general Abdul Gani Patail got to say about this? Is he still around?
