Is Najib saying High Court has no value?

YOURSAY 'High Court or Federal Court, the judgment should be the same.'

Najib, your IGP may have broken the law

Anonymous_3e86: There is no need for the mothers in the recent interfaith custody cases to go to the Federal Court. The High Court has already given its judgment. Why did Prime Minister Najib Razak suggest the Federal Court then?

Is it because the Federal Court is expected to make the judgment in line with the syariah decision? When the Federal Court makes such a decision, both the syariah and the civil courts will longer be in conflict.

Is that Najib's intention, so that he and his inspector-general of police (IGP) will not be criticised by the extremist groups?

Aries46: Puchong MP Gobind Singh, is there a possibility that there is more to this than meets the eyes? Prime Minister Najib Razak is clearly skirting the more important criminal issue of the IGP's refusal to enforce the High Court order.

Why does Najib not act against this open defiance, which is tantamount to mutiny by the top cop? What has the IGP that prevents the PM from exercising his authority against a straightforward case of delinquency by a public servant?

And as you rightly said, Najib’s directive to refer the matter to the apex court is redundant, in that there is already an existing High Court order that the police refuse to enforce.

In fact, Najib may just be buying time with this Apex court ploy, for what is the guarantee that it will be enforced if the Federal Court too were to decide in favour of the plaintiffs M Indira Gandhi and S Deepa?

Angel: The PM is not a lawyer. The cabinet may have lawyers but maybe they are half-past-six lawyers. The attorney‑general (AG) is probably not a good lawyer because he lost our Batu Puteh case. So his advice may not be any good. Furthermore, he never advised the government to appeal the Batu Puteh case.

AntiRacial: Is Najib trying to say the High Court order and its judgment has no value? High Court or Federal Court, the judgment should be the same, as this is not a criminal case and there is no new evidence produced by either party.

If the High Court order has no value, then better demolish the High Court building and remove the High Court from our juridical system.

Wira: The IGP is definitely acting above the law. Why is he not sacked?

Wandering Star: What law?! There is no law left in the country. It is about to reach the frenzied pace of a free-for-all lawless nation. Congratulations, Mr Umno PM. You have done this, your greatest achievement.

Anonymous_1398601876: The IGP is appointed by the Yang di-Pertuan Agong on the recommendation of our PM. Why is our PM not recommending to the Agong the sacking of the IGP and recommending another IGP?

Who is the biggest culprit here then? The IGP is taking instructions from the PM. In this case, if the PM tells the IGP to take action, surely the IGP would take action, or else he will be recommended for sacking.

Furthermore, if the Agong is following this case, he has the power to issue an order to sack the IGP without reference to the PM. After all, the Agong is the supreme commander of the Armed Forces and Polis Di-Raja Malaysia.

Headhunter: If anyone had any doubt that they would call in the military to take over, should the opposition win a general election, recent events do give a warning that we should not dismiss such a possibility outright.

The country's law is now not respected at all, and the police chief is now acting like a martial law chief. Where are all our civilian leaders when we need them most? Apart from former law minister Zaid Ibrahim, we have not heard from the rest.

Our constitution is being trashed and trampled on by the very people who are supposed to protect it with their lives. Are we descending into communism or what? By the way, in communist countries, the leaders are very much in charge. Ours is turning into a lawless society,m with the court becoming a toothless tiger.

Proud Malaysian: The way things are going, made worse by a total lack of leadership by the PM, the country is gravitating to a state of lawlessness. Court orders and AG's recommendations can now be ignored with impunity by the recalcitrant IGP and Jais.

Our neighbour, Singapore, has acquired a solid reputation as a country ruled by law and order. However, Malaysia's reputation in the eyes of the world will be, if not already, in tatters. Why should foreign investors bother to come to a country where they have no confidence in the judiciary and the government?

PM Najib, please show your leadership and courage to right the wrongs, otherwise you will go down in Malaysian history as the weakest and most cowardly PM Malaysia has ever had. It is a pity that your children will have to live with such a shameful legacy.

Louis: What has happened to this country? The IGP refuses to follow court orders. The Muslim convert husbands simply defy the order to return their children to the mothers despite the judge clearly telling them to do so.

The state Islamic authorities Jais and Mais do not pay a heed to the AG's order to return the seized copies of the Bible to the Bible Society of Malaysia. Najib, as usual, is indecisive and in this case, ignorant of the High Court ruling.

Foodforthought: These are the insincere and treasonous acts of this shameless, illegitimate Umno‑BN 'government' against the rakyat and the constitution. These agencies are there only to protect Umno‑BN's interests and nothing else, period.

Kangkung: The 'Middle‑Path‑Whenever‑It‑Suits‑Him' IGP dares to do what he is doing because he is invincible, as he knows not even Najib can touch him. The IGP probably has all the dirt needed to throw all of Umno's ministers into jail for good.

TehTarik: This is like 'Mutiny on The Bounty'. If the IGP himself refuses to comply with the law, why should the citizens? This country is splintering because of the lack of leadership at the very top.

If the IGP continues with his recalcitrant behaviour, we will soon be joining the ranks of failed states like Pakistan and those in Africa, where nobody bothers about the law. Chaos and a thousand small mutinies will reign. It will be the law of the jungle, with every man for himself.

Keturunan Malaysia: Former MCA chief Dr Ling Liong Sik: did you not once say the rot starts from the fish‑head down?
