IGP: We're not arresting Indira's ex-husband
Not Smart: Inspector-general of police (IGP) Khalid Abu Bakar, you just cannot sit and ask online news portals to do your job by asking them tell the public how the police are ‘trapped’ between court orders. What are you paid for?
You and your boss should get this sorted out immediately. Indeed, both you and your boss show little initiative, enthusiasm and seriousness in resolving this long-standing problem.
KDP: "He (Khalid) also said that Article 121 (1A) of the federal constitution places the syariah and civil courts at the same level."
Where does the police chief get his training from? The civil court is superior as it is a child of the constitution while the syariah court is made for legislating matters over Muslims from subordinate state legislation.
At no time can state legislation triumph that of the constitution. In this matter, it was a unilateral conversion that affects the right of a non-Muslim.
Furthermore, the child is a minor who cannot be expected to understand fully the matters of embracing faith. The courts are also in favour of awarding custody to the mother as long as the child is below 18.
The cops better wake up along with every other peasant in this country and accept that syariah courts by themselves are an affront to the constitution.
RKR: The IGP adheres to the civil court orders when it suits him and his religious belief. He does not want to follow the Ipoh High Court's orders because he says there is a Syariah Court order as well.
On the other hand, he warns people not to question the Federal Court’s decision on ‘Allah’ because the decision is obviously pro-Islam.
Geronimo: A fine mess we have got ourselves into and no thanks to Umno Baru. What does the IGP mean by not enforcing the order from the civil court and neither from the syariah court.
By not getting the child back, he is already enforcing the bidding of the Syariah Court. What does he take us for? Fools?
If the civil court is seen as impotent, then why bother with the civil courts at all. Just do away with it and we can live happily ever after, but then will we?
By right, the IGP should be held for contempt of court for not following orders from the civil court.
Hopeful123: An ex-IGP said that the police must carry out the court order. It appears that different IGPs have different SOPs (standard operating procedures). What a shame.
This IGP also wants all to respect the Federal Court's decision on the Allah ruling when he himself doesn't follow the court's instruction. It is clear that he is in full support of the syariah.
Democracy: Riduan Abdullah, ex-husband of Indira Gandhi, was found guilty of contempt and a court order was issued for his arrest. The IGP must act on the arrest order for contempt.
The issue here for the IGP is contempt and not child custody. Whether the syariah or civil court is superior is for AG (attorney-general) and the two courts to decide and not for IGP.
The IGP must act on the contempt order or else he is in contempt of court.
Ex-PJ: This is when the PM should step in to relieve this man of his duties. However, this will not happen as the PM is totally confused as to where his loyalties lie, his race/Umno or his duty.
Negarawan: Judicial commissioner Vazeer Alam made a landmark decision in April of stripping legal immunity from the IGP and AG. It is high time to charge the obstinate IGP in court.
Jiminy Qrikert: Once upon a time in Malaysia not too long ago, there was only civil law and it reigned supreme. Then Mahathirism emerged and along came syariah law but civil law still remained supreme.
Soon came the era of the false democrat, Najib Razak, with his middle-of-the-road, see-hear-say-nothing leadership, or rather non-leadership, and syariah law squared off with civil law as the law enforcer, middle-of-the-road IGP Khalid took his see-hear-say-nothing cue from his master and going one better, do nothing.
So we now have an emerging new Malaysia, a middle-of-the-road nation split down the middle between the Islamists and the non-Islamists on the militant scale and Muslims/non-Muslims on the social, the religious and the communal scales.
As long as Malays reject extremism, the non-Islamist scale will weigh far heavier. But the Muslim scale will always weigh twice heavier than non-Muslims and will get heavier in years to come.
And the tipping of Muslims into the Islamists scale will grow till militant extremism rules.
Dr Suresh Kumar: The people should understand the IGP's painstaking effort to respect both the civil court's decision and the syariah court's.
He is torn apart and only he knows the mental anguish he is subjected to, not even the mental anguish and sufferings of the children in the middle of this ugly religious, custody battle can match what our poor IGP is going through.
He is suffering alone in the middle path and not even one federal constitutional expert is willing to advise him as to which courts come under the supreme federal constitution and which courts come under the state legislation.
You see, we subject the poor IGP to so much trouble and confusion and yet have the gall to call him obstinate, arrogant, recalcitrant, ‘bodoh sombong’ and what not.
Give him a break, folks, he is doing a great job for the nation and deserves to be a minister in Najib's cabinet. Such is this IGP's legacy. May Malaysia have more and more intelligent officers like this.
Ian2003: Such defiance. Then again since the AG is not charging him for contempt of court, what can we do?
