Ex-cop sent to jail for causing hurt to Kugan
A former police constable will serve three years in prison after his final appeal against conviction for causing hurt to a detainee was dismissed today.
Court of Appeal president Md Raus Sharif sat with Balia Yusof Wahi and Hamid Sultan Abu Backer to decide on V Navindran’s appeal against conviction and sentence for the offences against A Kugan six years ago.
Justice Raus said the court did not find any appealable error by the High Court to affirm the Sessions Court decision to convict Navindran on two alternative charges of causing hurt to Kugan, a suspect in a luxury car theft.
“We also see no reason to disturb the jail sentences passed against him. We are of the view, on the circumstances of the case, that the sentence imposed by Sessions Court was not manifestly excessive,” said the judge.
Navindran, 35, appeared calm as police led him to the court lockup following the Court of Appeal ruling.
Later through his counsel S Ramesh, he expressed his remorse over Kugan’s death and said it should not have happened and that hopefully such incident would never happen in future.
On June 11, 2012, the Sessions Court in Shah Alam found Navindran guilty of two alternative charges and sentenced him to three years’ jail for each offence.
The terms are to run concurrently.
He committed the offences in an interrogation room at the Taipan USJ police station in Subang Jaya between 7am and 4pm on Jan 16, 2009.
Kugan, 23, from Puchong, was arrested on Jan 14, 2009, to help in investigations into a luxury car theft syndicate. He died six days later in police custody.
Deputy public prosecutor Lailawati Ali and Azlina Rasdi appeared for the prosecution.
