NGOs outraged at 'NFA' on alleged cop rape threat

Civil society groups are outraged that the case related to a policeman's alleged rape threat against detainee Maisara Amira has been closed with no further action.

According to NGO Lawyers for Liberty (LFL), investigating officer for Maisara's complaint informed her lawyers on June 29 the Attorney-General’s Chambers has classified the case as ‘no further action’.

"This is extremely shocking and unconscionable to say the least as this decision was done after a long delay and without any explanation," said LFL in a joint statement with Empower, supported by 13 other NGOs.

"It is very clear that this ‘NFA’ decision shows that the police and the AG’s Chambers are not taking threats of violence against women seriously.

"This decision comes as a surprise because no identification parade was carried out for Maisara to identify the perpetrator, despite the fact that Kuala Lumpur police chief Tajuddin Md Isa had said that the policeman in question had been identified but will continue his duties until further notice," said the group.

Maisara was one of the detainees in the massive anti-GST rally on May 1.

She filed a police report on May 8 alleging that on 5 May, during her detention at Dang Wangi police station, a policeman had threatened to rape her, film the act and sell the footage.

'Cops not serious'

The NGOs also slammed the officer for attributing the absence of an identification parade to a lack of instruction to do so by the AG's Chambers.

 

"Such apathy and incompetence is outrageous, and it is very clear that Maisara’s complaint has not been taken seriously from the outset.

"The ‘NFA’ classification is arbitrary, opaque and a lazy manner of closing a case without giving sufficient reasons as to why this case will no longer be investigated.

"The authorities need to be more accountable and transparent for their decisions especially public interest matters," said LFL and Empower, adding such a “business as usual” attitude is shocking considering other such incidents have been reported.

The NGOs demanded the case to be reopened for an independent investigation.
