Palanivel’s bid to get RM1m damages rejected

Former MIC president G Palanivel today failed in his application for RM1 million in damages against Ampang Jaya MIC branch chairperson N Muneandy for his suffering during an injunction period obtained by Muneandy.

High Court judicial commissioner Mohd Zaki Wahab dismissed Palanivel’s application in chambers.

Muneandy’s lawyer, A Vasanthi, told reporters the court held that her client had locus standi to bring the action against Palanivel and the injunction was lawfully obtained by Muneandy.

“The court also held that Muneandy had valid cause of action to obtain the injunction,” she said.

On July 6, Muneandy obtained an injunction from the High Court to restrain Palanivel from carrying out duties as MIC president, from holding any gathering in the party and from approving any resolution on behalf of the party.

On July 2, Muneandy filed an originating summons against Palanivel, seeking  for the injunction.

Then eight days after obtaining the injunction, Muneandy withdrew the originating summons following the Court of Appeal’s dismissal of Palanivel’s appeal to set aside a directive by the Registrar of Societies (ROS) for the party to hold fresh elections.

In dismissing Palanivel’s appeal on July 13, the Court of Appeal ruled that the ROS had not acted beyond and exceeded its powers when issuing the directive for MIC to hold fresh elections.

Palanivel, former MIC vice-presidents S Sothinathan and S Balakrishnan, and former MIC secretary-general A Prakash Rao had appealed against a High Court ruling on June 15, which rejected their judicial review application to quash the ROS directive.
