BN secretary-general Tengku Adnan Tengku Mansor will apply to strike out the suit filed by PKR and several opposition leaders regarding the 1MDB allegation.

Umno-linked lawyer Mohd Hafarizam Harun told Malaysiakini that Tengku Adnan received the suit yesterday.

“We (on behalf of Tengku Adnan) will file to strike out the suit,” Hafarizam said when met at a dinner last night at a hotel to celebrate Singapore's 50th National Day celebration hosted by Singapore’s High Commissioner to Malaysia Vanu Gopala Menon.

Hafarizam ( photo ) said case management for the PKR action has been fixed for Sept 3.

According to Hafarizam, the striking out is just one option. There are other options, including asking for security as possible costs or asking further details.

Hafarizam added that while he is representing Tengku Adnan, he had yet to receive instructions to represent Prime Minister Najib Abdul Razak.

 

PKR has named Tengku Adnan, Najib, 1MDB and the Election Commission as defendants in the suit.

It remains unknown whether Najib, 1MDB and the EC will file similar striking-out applications.

PKR, along with its de facto leader Anwar Ibrahim, former party secretary-general Saifuddin Nasution Ismail, PKR vice-presidents Nurul Izzah Anwar and Chua Tian Chang (Tian Chua), and former PAS Kuala Selangor MP Dr Dzulkefly Ahmad, who is now with Gerakan Harapan Baru, are the plaintiffs.

Their suit was filed on Aug 12 , through the firm of Tommy Thomas. In it, the plaintiffs are claiming money laundering, corruption and rigging of the 13th general election with the use of public funds.

They also state in their suit that Najib, as the finance minister and chairperson of the 1MDB board of advisers, also breached his fiduciary duty through the entry of RM2.7 billion into his personal bank accounts.

Several declarations sought

All six are seeking several declarations, among them that Najib committed corrupt practices with the fund of RM2.7 billion entering into his personal accounts; that the BN be de-registered; that the conclusion of the 222 parliamentary seats had been compromised; and that the results of GE13 be therefore set aside.

They also want the court to rule that each of the defendants, either acting individually or with each other, had maliciously and dishonestly practised fraud on the Malaysian electorate by the commission of corrupt and illegal practices, and as a consequence the results of GE13 should be declared null and void.

PKR, Anwar, Saifuddin, Dzulkefly, Nurul Izzah and Tian Chua are also seeking a fresh general election be held within 120 days of the court order and that the said election be conducted freely and fairly, in accordance with the Federal Constitution.

They also want orders that an inquiry be held on 1MDB or 1MDB-related companies dealt with by Najib and BN for the purpose of the GE13, and that any payment that the prime minister received from 1MDB or other sources used for the said elections be disclosed.

Tourism Minister Nazri Abdul Aziz ( photo ) had described the suit as "stupid" and called on those behind the suit to prove that each BN candidate spent more than RM200,000 in their campaign for parliamentary seats.

A cap of RM100,000 is imposed on each contestant for a state seat, which total 505 seats throughout the country.

It was reported that 1MDB is now being investigated by Bank Negara, police and the Malaysian Anti-Corruption Commission and also Parliament's Public Accounts Committee.
