Former Selangor menteri besar Mohd Khir Toyo is presently warded at the National Heart Institute today, a day before the Federal Court’s decision on his graft case.

He is said to have fallen down while jogging earlier this morning, allegedly following a heart attack.

SuaraTV obtained a picture of him lying on a hospital bed.

Checks by Malaysiakini with IJN confirmed that the former Sungai Panjang assemblyperson is presently being warded at the nation's leading heart institute.

He is warded at level 2, according to a hospital staff.

Meanwhile, Bernama reported Khir Toyo was rushed to the Selayang Hospital in Kuala Lumpur when he collapsed after returning from a jog around his home in Section 7 Shah Alam this morning.

A source from his office when contacted by Bernama said Khir passed out at home at 9am causing his family to panic and summoning an ambulance.

The source added that after receiving treatment at Selayang Hospital, Khir was referred to the National Heart Insitute in the federal capital for

further checks.

"As of 6pm, his condition had stabilised and he could talk but is still in the ward for more checks," the source said.

Khir, formerly the Sungai Panjang assemblyperson, is charged with obtaining two lots of land and a house at No 8 & 10, Jalan Suasa 7/1L for himself and his wife Zahrah Kechik (photo), from Ditamas Sdn Bhd director Shamsuddin Hayroni, at RM3.5 million - a price much lower than the RM6.5 million Ditamas paid for it in 2004.

The former Selangor menteri besar is sentenced to 12 months’ jail by the Shah Alam High Court on Dec 23, 2011, for graft by a public officer , related to his Balinese mansion in Shah Alam.

The court also ordered the confiscation of the said property.

The three-member bench at the Court of Appeal also upheld the jail sentence and the forfeiture of the said property. The decision was made by Justice Abu Samah Nordin, Justice Azahar Mohamed, and Justice Aziah Ali.

Justice Abu Samah and Justice Azahar are now Federal Court judges while Justice Aziah, who is an appelate court judge, has also been called upon as a panel member at the Federal Court.

Chief Judge of Malaya Justice Zulkefli Ahmad Makinudin led the five-member bench that heard Khir's appeal on Jan 19.

The other judges besides were Federal Court judges Ahmad Ma'arop, Jeffrey Tan Kok Wha, Hasan Lah, and Ramly Ali.

Justice Tan who approached the age of 66 on May 16, which is the maximum retirement age for judges, have had his contract extended by six months.

It remains to be seen whether the apex court will give its verdict tomorrow.
