Five DAP leaders were called to the Kajang police district headquarters for questioning this morning, regarding their presence at a toll protest flashmob following the toll price hikes.

They are Serdang MP Ong Kian Ming, Selangor exco member Ean Yong Hian Wah, Balakong assemblyperson Eddie Ng, Senator T Chandra Mohan and Selangor DAP Socialist Youth chief Eric Teh.

Ong ( photo ) said they were not charged with anything yet and that they were merely questioned about the toll protest which took place at the Batu 9 Cheras toll plaza on Oct 17.

"Our approach was that we would answer any of the allegations that they have against us in court, if they decide to charge us," Ong told Malaysiakini .

While they are not being charged for now, he admitted that if the authorities choose to charge them, they can, although he does not know what law it will be under.

Segambut MP Lim Lip Eng and Ipoh Timur MP Thomas Su were also there as their lawyers, while DAP national vice-chairperson Tan Kok Wai showed up in solidarity.

Ong suspected that the authorities wanted them to reveal the main organiser of the event, so that they can charge them under Section 9(5) of the Peaceful Assembly Act (PAA), which criminalises failure to give notice.

"But we refused to give any answers on who organised the thing," he said.

Previously, the Court of Appeal had ruled in a landmark decision that Section 9(5) of the PAA was unconstitutional in the Nik Nazmi Nik Ahmad case last year.

On Oct 1 this year though, the same court unanimously ruled that the particular section was constitutional instead.
