Prime Minister Najib Abdul Razak's application to strike out PKR and its de facto leader Anwar Ibrahim's suit over the RM2.6 billion donation entering into the former's personal bank accounts will be heard on Dec 14.

The date was fixed following case management today at the High Court in Kuala Lumpur before Judicial commissioner Mohd Zaki Abd Wahab.

Lawyer Michelle Kummar for PKR and six others said they would be submitting affidavit in reply to Najib's application today.

Initially, lawyer Mohd Hafarizam Harun for Najib and BN secretary-general Tengku Adnan wanted the striking out application be fixed before Najib's long-awaited reply on the RM2.6 billion donation in Parliament to avoid it having legal ramifications due to the court case.

The reply is scheduled on Dec 3, the last day of the Parliament session.

With today's development, it remains uncertain whether Najib will stick to his decision to give the answer on Dec 3.

It was previously reported that Zaki had granted Najib's stay application to stop Najib along with 1MDB, AmIslamic Bank and Affin Islamic Bank from submitting the accounts related to the transfer following a discovery order sought by the applicants.

AmIslamic Bank holds three of Najib's personal accounts where RM2.6 billion was purportedly deposited, while AffinIslamic is the bank where Ihsan Perdana Sdn Bhd, a 1MDB subsidiary, has an account with.

Anwar, vice-presidents Nurul Izzah Anwar and Tian Chua, former secretary-general Saifuddin Nasution Ismail and former PAS member Dr Dzulkefly Ahmad, named Najib, Tengku Adnan, 1MDB and the EC as defendants in the suit, claiming that public funds had been used in money-laundering, corruption and rigging of elections.

They wanted the 13th general election results to be declared null and void.

This follows reports by The Wall Street Journal and Sarawak Report that RM2.6 billion had somehow found its way into Najib's personal bank accounts and possibly used for the 13th general election.
