'So much for AG's 99pct chance of success'

Attorney-general Apandi Ali must drop all charges against Khairuddin Abu Hassan and Matthias Chang, after the High Court disproved his "99 percent chance of success" strategy, Suaram said.

"Failure to do would contravene the AG's statement that prosecution would not take place unless he is certain of 99 percent chances of conviction.

"In this case, the decision by the High Court clearly sided with the one percent, and should thus be an end to this ill-advised misadventure," the human rights NGO's executive director Sevan Doraisamy said in a statement.

The High Court yesterday said the charge of sabotaging financial services against the duo is not a security offence under Security Offences (Special Measures) Act, and granted them bail.

Apandi had earlier said the sedition case against NGO leader Mohd Ali Baharom, or Ali Tinju, was dropped because the chambers will only pursue cases with "99 percent chance of success".

'Proof that Sosma abused'

Khairuddin, a former Umno division deputy chief, and his lawyer Chang were charged with sabotaging financial services, when they lodged reports with international agencies over 1MDB.

They were not allowed bail for more than a month, because the charge was categorised as a security offence under Sosma.

The High Court ruled it is not a security offence and instructed them to stand trial at the Sessions Court.

Sevan said the episode shows how Sosma's detention without trial provisions can be abused.

The "draconian and unconsionable law" must be repealed, he said.

"Draconian laws such as Sosma is not the way to protect the safety and security of Malaysia but the first step in converting Malaysia into a police state.

"As Malaysians, we must not allow this to be our future," he said.
