Charles Suresh Morais said he will consult his attorneys before deciding on his next course of action regarding the purported pen drive he claimed to have received from his brother, former deputy public prosecutor, before the latter’s brutal murder.

"I plan to meet and speak to my attorney next week. These questions asked require legal counsel for consultation," Charles told Malaysiakini in an email last night, when asked what his next plans were regarding the controversial drive.

"It would be a death wish to come back (to Malaysia) now," he added.

He said he would also have to consult with his attorneys on whether to take action against his younger brother, Richard Dilaan Morais, and the other "people involved".

The two brothers had fought over Kevin's remains, and the younger sibling has also attacked him for the explosive statutory declaration (SD) that Charles made on Thursday alleging conspiracy in Kevin's death.

In Charles' SD, he had claimed that Kevin had confided in him that he was working on a case involving Prime Minister Najib Abdul Razak and his wife Rosmah Mansor.

He had also claimed that Kevin had sent him a pen drive via courier containing evidence that implicated individuals in power, and he (Charles) had arranged for its contents to be revealed if anything should befall him.

Inspector-general of police (IGP) Khalid Abu Bakar revealed yesterday that Charles left the country via the Johor Bahru causeway, the same day after making his SD.

The police are investigating Charles under Section 202 of the Criminal Procedure Code for withholding information and Section 124L for attempt to commit sabotage, Khalid said.

Rushed cremation questioned

"I must say I am puzzled as to why the IGP is so focused on wanting me to come back," said Charles.

He further explained that he had notified the police, the Attorney-General's (AG) Chambers and the hospital that he was waiting on a court order to get a second opinion on the autopsy.

This was after the AG’s Chambers said he would need a court order to get a second opinion on the autopsy, following which had filed for one immediately.

In the interim, all three parties involved were given notice not to allow Kevin's remains to be removed from the morgue, he said.

"They even went as far as to say it would cost money to keep the body in the mortuary, (for) which I readily agreed I would foot the bill.

"The million dollar question is, why would the same police station that was put on notice, allow Richard's report to be used to get the body out and quickly cremate it?

"What was being hidden?" he asked.

Kevin's remains were found in a cement drum at Persiaran Subang Mewah, Subang Jaya, near Kuala Lumpur on Sept 16.

He was reported missing on Sept 4 and was last seen leaving his apartment at Menara Duta in Kuala Lumpur to Putrajaya.

On Sept 28, six men were charged with Kevin's murder while two others, including the army pathologist, were charged with abetment.

Kevin had been seconded to the Malaysian Anti-Corruption Commission (MACC) which has been investigating the RM2.6 billion political donation and RM42 million from SRC International which were deposited into the prime minister’s personal accounts.
