'Nasrudin dangerously close to breaching settlement with Lim'

Temerloh MP Nasrudin Hassan is teetering “dangerously close” to breaching the out-of-court settlement between him and Penang Chief Minister Lim Guan Eng, lawyer Syahredzan Johan says.

Following their court settlement, Syahredzan said, the only information that should emerge is the terms of the settlement and nothing else, unless the parties have agreed not to disclose the terms as well.

The discussions regarding the settlement should only be privy to the parties in the dispute, their lawyers and the presiding judge.

“There should be nothing else said; there should be no other explanation, statement and so on and so forth that is related to that case.

“(That's) because the parties have decided that this is it – there is no more dispute between them with regard to the issue. They are therefore going to end it,” Syahredzan ( photo ) told Malaysiakini when contacted.

Nasrudin withdrew portions of a Aug 6, 2014 statement that he made and was ordered to pay RM10,000 in compensation, following a settlement that was reached yesterday.

In the retracted portion of statement, Nasrudin had alleged that Lim had used direct negotiations to award a RM4.63 billion project to Consortium Zenith BUCG Bhd.

Two postings on PAS website

After the retraction, Nasrudin made two postings on the PAS website about the settlement, in his capacity as PAS information chief.

He claimed that, among others, he was prepared to defend himself against Lim's lawsuit, but Lim's lawyers approached him, “anxious” for a settlement.

Following this, Lim's legal adviser Raja Syarafina Raja Shuib warned of legal action against “those who, through the media, continue to twist and spin the facts related to the amicable solution”.

Syahredzan said he believes Nasrudin has yet to reveal anything confidential about the settlement, but has come close to doing so by alluding what was discussed in the mediation.

He cautioned that if Nasrudin does cross that line, it would undermine the spirit of the mediation and the case could be reopened.

Lim's lawyers could then apply to the court to set aside the consent order, on grounds that Nasrudin acted in contempt of the consent order, or that the order has become redundant because of Nasrudin's statements.

“That's why when parties ask for settlement, they should just keep quiet and move on with their lives. If anyone asks, just show that these are the terms.

“There is nothing more than what is said; there is nothing less than what is said (in the terms). You cannot read more into the terms of the agreement outside those four walls of the settlement terms. That's it,” Syahredzan said.
