The Kuala Lumpur High Court today prohibited Ampang Jaya Municipal Council (MPAJ) from implementing a new coupon parking system to replace the pay and display system.
It granted an injunction application made by parking concessionaire Suasa Efektif (M) Sdn Bhd against MPAJ.
The decision was made by Justice Amelia Tee Hong Geok Abdullah who gave the order to prevent MPAJ from taking over the operation, management and maintenance of parking facilities in Ampang Jaya.
She also suspended the termination of the parking concessions agreement against the municipality until the final disposal of Suasa Efektif's suit for wrongful termination.
Suasa Efektik in its suit said the company was given the parking concession agreement by the Selangor government until Dec 31, 2021.
It further claimed that MPAJ had announced on Dec 30, last year, that it would implement the new coupon parking system to replace the pay and display system.
The company claimed many residents and business operators were unhappy as they were kept in the dark and felt that more time is needed before it is to be implemented.
Suasa Efektif's chief executive officer, Zainuddin Othman, on commenting the decision, hopes that MPAJ will respect and abide by the order and will not arbitrarily discontinue the 'pay and display' system which it had been operating since 1999.
The lawyers representing the company were Bahari Yeow Tien Hong, Muhammad Faizal Faiz and Fawza Sabila, while MPAJ was represented by Dominic Pillai and Noor Adzraii.
Justice Amelia Tee has fixed hearing of the suit on March 3.
