MP to push for ban on pregnancy tests by employers

Ampang MP Zuraida Kamaruddin will propose amendments to labour laws to bar employers from mandating urine tests on prospective employees to check if they are pregnant.

This comes after the Shah Alam High Court slashed by 90 percent the quantum of compensation awarded to teacher Noorfadillah Ahmad Saikin, who lost a job offer as a relief teacher after the government found she was pregnant.

The court this week slashed the award from RM300,000 to RM30,000 as compensation to discourage profiteering as Noorfadilla's loss of income would not have amounted to RM300,000.

"I view this matter very seriously. The verdict has made a dent in our progress to champion for gender equality and human rights. I will not sit quietly," she said.

Noorfadilla filed the case seven years ago after her job offer as a relief teacher was recanted when the government found out she was pregnant.

She was the first to successfully use the Convention on the Elimination of All Forms of Discrimination against Women (Cedaw) in a gender discrimination case in Malaysia.

The government lost all appeals, but continued to appeal against the damages awarded to the teacher.

Zuraida said pregnancy should be celebrated and supported by society and not punished.

"I am at a loss at how the court of law delivers justice," Zuraida said.

"This landmark case should have served as a proper reminder to all employers never to discriminate against pregnant women, but what happened was a slap on the face of the victim and all women as the hugely reduced sum simply does not correspond to the damage inflicted," she added.
