Selangor served with stay order over SUKE land acquisition

Four people who are trustees of Tan Bok Yin @ Tan Hon Yin have obtained a stay order from the Kuala Lumpur High Court against the Selangor government and the state Lands and Mines Department to stop the acquisition of a 1.25ha piece of land in Hulu Kelang in Gombak district for the Sungai Besi-Ulu Klang (SUKE) highway project until the disposal of their judicial review application.

The KL High Court had on Feb 22 granted leave (permission) to the four, namely Tan Wei Mia, Tan Wai Cheong, Tan Wai Chong, and Tan Boon Chit, who are the trustees of Tan Bok Yin, to initiate the judicial review.

The order states that all proceedings in the acquisitions of the SUKE project or the intended acquisition of the application be stayed until the disposal of the hearing of the judicial review application.

The trustees wanted a certiorari order to quash the order by the Selangor government to acquire the said land and that the declaration be declared null and void.

A copy of the sealed order was served to the Selangor government today, according to lawyer Choo Mun Wei from the law firm of Mah Weng Kwai and Associates.

Choo told Malaysiakini that the matter was fixed for case management tomorrow, but is uncertain that the respondents could come.

Meanwhile, the Say No to SUKE and Damansara Shah Alam express way (Dash) action groups announced that they have lodged police reports against the Selangor government over its treatment of their plight.

SUKE is a 31.8km-long highway project spanning Sungai Besi to Ulu Klang.

In a statement today, the action group laid out specific charges against the Selangor government in those police reports, including the failure to follow the procedures stipulated in the Town and Country Planning Act.

While Selangor Menteri Besar Mohamad Azmin Ali had claimed that all the concerns that the residents raised have been addressed, he did not go into specifics on how this was done.

“Today, we would like to tell Azmin and the Selangor government that they need to do better than make general statements and claim that they are a model government that listens to the people.

“We are here to tell the Selangor government that they do not listen to the public,” the statement said.

“The four trustees’ stay order means that all all land acquisition activities related to the SUKE project after Feb 22 are deemed frozen/stayed, and more importantly, the Kuala Lumpur High Court recognised and acknowledged that the issues we have raised are valid and should be judged in a court of law, contrary to the Selangor government’s position.

“With this court order, we trust that the Selangor government will halt all SUKE-related activities until the decision of the judicial review is complete,” the action committee said, adding that while the decision was limited to SUKE, their friends fighting against the Dash highway are also exploring plans to take up a similar action against the Selangor government.
