Wanita MCA reiterates urging for sex offenders registry

Wanita MCA has reiterated its call for a sex offenders registry be introduced into legislation, following the conviction and sentencing of British paedophile Richard Huckle yesterday.

The wing's chairperson Heng Seai Kie said Malaysian legislation must be changed to enhance protection from "paedo-beasts".

She also expressed horror that the "prolific and depraved" Huckle would be eligible for parole after 23 years in jail.

This is after the British court handed him 22 concurrent life sentences yesterday after he pleaded guilty to 71 counts of child sex offences.

Heng said that while they respected the jurisdiction of the British court, Wanita MCA is still horrified that Huckle could possibly be freed at the age of 53.

"We are horrified that the sex fiend (Huckle) will be eligible to appear before a parole board after 23 years, when he will be 53 years of age - possibly still spry and active, and capable of repeating similar offences once freed," she added in a media statement today.

She cited the example of New York's oldest inmate Theodore Sypnier, who at the age of 90, admitted to raping and sodomising a four-year-old girl and her seven-year-old sister.

With the Sex Offenders Registry, Heng said convicted paedophiles and rapists would have their addresses published on the police website and Facebook as well as in newspapers, online news portals and at local councils upon their release.

"This is necessary to safeguard the safety of all, especially minor children who live in the vicinity," she added.

Heng also suggested reforms for the Penal Code, Child's Act 2001, Computer Crimes Act 1997 and various others.

Among her suggestions was to charge Malaysian citizens for committing paedophilia abroad as there are currently no Malaysian legislation which provide for this.

Following that would be to have double jeopardy sentencing for Malaysian citizens charged and convicted for committing paedophilia overseas.

There would also be a need for mandatory incarceration for possession of, surfing and downloading child pornography material from websites.

Sex offenders must also be disallowed accesss and usage of computer and internet facilities for a minimum number of years to be determined by prison authorities.

Expand definition of rape

Wanita MCA also called for the definition of "rape" to be expanded beyond its current description of "penile penetration into the vagina against one's will".

Heng said the new definition should include the insertion of any object into any orifice of the human anatomy, such as the vagina, anus, mouth, nose and ear.

The definition of "any object", she added, would refer to anything such as finger, bottle, ice cylinder, fruits and so on, as long as it is a coerced intrusion.

She said the definition of rape must also be gender neutral to include men being raped, regardless of whether they were raped by fellow men or by women who forced foreign objects into their orifices or underage minor boys who have been sexually molested, abused or inappropriately touched by adult men or women, even if it was consensual.

"We also call on all crime prevention and child welfare authorities to disseminate their information cross-boundary immediately after confirmation is obtained that a suspected paedophile has travelled abroad.

"This is to enable immigration authorities to deny the suspect entry into one’s country, detention and deportation if legally legitimate, and to immediately inform their counterpart on the suspect’s whereabouts.

"Child sex predators are known to seek impoverished victims in similar destitute communities in Cambodia and Sri Lanka," she added.

Heng expressed regret that the Australian authorities did not share their information on Huckle with the Malaysian police despite most of the victims being Malaysian children and also that the UK's National Crime Agency took three months before finally relaying this information to Malaysia in November 2014.

Huckle had pleaded guilty to 71 offences and was found with over 20,000 indecent images of children on his computer and camera when he was arrested at Gatwick Airport in 2014.

He is one of the most prolific child sex abusers known to have operated in Malaysia, where the authorities have been criticised for failing to tackle sex crimes properly against children.

Huckle abused his victims over a period of nine years between March 2006 and December 2014. All the crimes took place in Malaysia, apart from the first incident which involved the abuse of a two-year-old child during a visit to Cambodia.

He had also boasted of his crimes online and had written a 60-page manual advising other paedophiles on how to abuse children.
