The High Court in Kuala Lumpur was told today that the third accused in the murder of deputy public prosecutor Anthony Kevin Morais surrendered himself to the police a week after the lawyer's body was found.
Intelligence officer at the Criminal Investigation Department of the Sentul district police headquarters, Inspector Ridhuan Abdul Razak, said R Dinishwaran, 24, surrendered himself at the Sentul police station on Sept 22 last year, a week after Morais body was found, which was on Sept 16.
He said Dinishwaran went to the Sentul district police headquarters at 3pm and was accompanied by a lawyer and another person.
"On Sept 22, 2015, when I was at the CID office of the 4th floor, an Indian man came to surrender himself. The man was Dinishwaran," he said during examination-in-chief by deputy public prosecutor Nurfaida Mohd Rashidee on the 24th day of the trial of the case.
Ridhuan, who is the 33rd witness, said he then arrested Dinishwaran and explained to him the reason for the arrest, as well as read out his rights under Section 28A of the Criminal Procedure Code.
"After arresting him, I handed him over to Investigating Officer ASP Wan Abdullah Wan Said," he said, adding that he also made a report on the arrest.
Cross-examined by lawyer M Manoharan, representing Dinishwaran, Ridhuan said he agreed with the lawyer that Dinishwaran surrendered himself to the police after reading a report in a Tamil newspaper on the police looking for him to assist investigation of a case.
However, to a question from deputy public prosecutor Saiful Edris Zainuddin during re-examination, whether he was informed by Dinishwaran on the contents of the newspaper report, Ridhuan said no.
Meanwhile, an officer with the Bukit Aman Special Task Force on Organised Crime (Stafoc), Supt Hazril Kamis, who is the 34th witness, said he arrested the fourth accused, A K Thinesh Kumar, 23, at his house in Taman Desa Aman 3, Sungai Lalang, Bedong, Kedah.
He said the arrest was made on Sept 16 last year following an instruction from Supt Shazeli Kahar.
Questioned by deputy public prosecutor Mohammad Izzat Fauzan on the condition of the accused when he was arrested, Hazril said Thinesh Kumar gave his cooperation to the police.
Hazril said he also seized two Samsung handphones with SIM cards from Thinesh Kumar before bringing him to the Sentul district police headquarters and handing him over to a police officer.
Dinishwaran and Thinesh Kumar are among six men who had pleaded not guilty to charges of murdering Kevin Morais between 7am to 8pm, on Sept 4, 2015 between Jalan Dutamas Raya, Kuala Lumpur and No.1 Jalan USJ1/6D, Subang Jaya.
The others are G Gunasekaran, 48, M Vishwanath, 26, S Nimalan, 23, and S Ravi Chandaran, 45.
Col Dr R Kunaseegaran, 53, who is the first accused, had pleaded not guilty to a charge of conspiring with the six men to murder Morais at the same place, date and time.
The trial before Judge Azman Abdullah continues on Tuesday.
