Bersih chairperson Maria Chin Abdullah has filed a judicial review application at the Kuala Lumpur High Court to stop the Election Commission (EC) from proceeding with the redelineation exercise.

The application filed on Monday by Messrs Ramrais and Partners had named the EC as the sole respondent.

Maria, a voter in the Petaling Jaya Utara constituency, is seeking a declaration that sufficient land mass information be furnished to the public for each parliamentary and state seats.

She has alleged that the EC had acted in bad faith, illegally and committed procedural impropriety when issuing the notice for redelineation to all constituencies.

Maria said the commission was withholding the information on land mass from the public which would only be revealed to Parliament or state legislative assemblies later.

She claimed that such information was needed to enable voters to make an informed decision as there was no guarantee that Parliament or the legislative assemblies could scrutinise the EC proposals competently or effectively.

Furthermore without the information, voters could not make an effective objection as required under Section 5B of the 13th Schedule of the Federal Constitution.

The Bersih chairperson further claimed that she and voters would not be treated fairly without the proper information given.

The matter came up for case management before Justice Hanipah Farikullah today.

Today is also the last day for objections to be filed to the EC.

EC making a preliminary objection

Maria's lawyer Syahredzan Johan told Malaysiakini when contacted today that EC, which is represented by senior federal counsel Amarjeet Singh, would be making a preliminary objection.

Justice Hanipah has fixed Nov 22 as the hearing date to hear the preliminary objection.

Amarjeet has indicated to the court that EC may file an affidavit with the preliminary objection raised, said Syahredzan.
