Youth and Sports Minister Khairy Jamaluddin Abu Bakar today dismissed the court testimony made by jailed opposition leader Anwar Ibrahim that he was immune to any action.

Taking the witness stand for the second time in Anwar's suit against him for defamation, Khairy told the High Court in Kuala Lumpur that he did not have an office on the fourth floor of the Prime Minister's Department at the material time in 2008.

"I deny being immune (kebal) as asserted. I also did not own an office at the fourth floor," he said in responding to questions from his lawyer Muhammad Shafee Abdullah.

Shafee: Were you holding any government post when you made the speech in Lembah Pantai in 2008?

Khairy: No.

Shafee: Were you occupying the fourth floor (of the Prime Ministers Department)?

Khairy: No.

Shafee: Can you tell the court on the issue of 'kebal' (immunity)? Is it because of your relationship with the PM as his son-in-law? Did you feel encouraged that you will be protected?

Khairy: Of course not.

Yesterday, Anwar testified that Khairy slandered him at a political ceramah in 2008 as the Umno Youth chief had considered himself being "young and immune" to any action.

Khairy felt immune as he was the son-in-law of then prime minister Abdullah Ahmad Badawi, the former deputy prime minister added in his witness statement.

Earlier, newly-elevated judge Justice Azizul Azmi Adnan allowed the application by Shafee (photo) to question Khairy further following Anwar's answers yesterday.

Anwar had filed an RM100 million defamation suit against Khairy nine years ago, over what he said at a political ceramah in Lembah Pantai on Feb 19, 2008, which was carried by Malaysiakini.

'I wrote speeches for Pak Lah'

The jailed opposition leader complained the words uttered by Khairy meant that he was a homosexual, likes to engage in vice and that he was not fit to be a leader.

Questioned by Anwar's lawyer Sivarasa Rasiah today, Khairy said he was appointed as the deputy principal private secretary to Pak Lah in 2003 and worked for about a year.

He added that his job with the former prime minister included writing speeches, preparing policy briefs and research.

Khairy further denied he had a role in shaping (government) policies, maintaining that the "cabinet formulates policy".

“I provide the research materials,” he added.

Khairy also disagreed with Sivarasa's assertion that his position as Abdullah's son-in-law and deputy principal private secretary held much influence.

Sivarasa: I put it to you that you had been a person with much power.

Khairy: I disagree.

The minister also denied planning the Sodomy II roadshows and insisted that the Kelana Jaya event, held soon after Anwar's conviction on Feb 2015, was the only one.

Khairy said the event was to explain to the people on what transpired and he denied the claims that the Sodomy II trial was a political conspiracy.

Sivarasa: Did you plan the others?

Khairy: I planned only one, the one in Kelana Jaya.

Sivarasa: What about the others?

Khairy: I planned only one.

Sivarasa: How about the others?

Khairy: I did not plan any other event.

Sivarasa: Why stop after the talk in Kelana Jaya?

Khairy: It has served its purpose.

Sivarasa: I put it to you that because there was a public outcry to conduct it, and the conduct of your counsel (Shafee).

Khairy: I disagree.

Sivarasa: I put it to you that you actually announced your participation in the other planned road shows?

Khairy: Not true.

Sivarasa: The events were cancelled following criticism inside BN?

Khairy: I disagree

The minister agreed that he did not attend any of the court proceedings regarding Anwar but admitted he read the judgment and also followed media reports.

He further disputed Sivarasa's contention that Anwar's Sodomy II trial was a political conspiracy. This is despite being alerted by Anwar's lawyer to findings of a United Nations working group and that of the Inter-Parliamentary Union – where Malaysia is both a member.

Anwar took the stand in the afternoon for cross-examination, where he disagreed with Shafee that the words uttered by Khairy, “Anwar main belakang kedua-duanya”, were limited to political connotation.

“The words also have sexual meaning and 'maksiat' (vice). It seems to represent that I engage in activities contrary to Islam and was guilty of sodomy,” he said.

The hearing before Justice Azizul continues on Monday.
