Azmin: Court said EC fell short of international transparency standards

Selangor Menteri Besar Mohamed Azmin Ali said the court had found that the Election Commission (EC) did not live up to international transparency standards, despite dismissing the state government's suit against the redelineation exercise.

"In his oral decision, the judge found that the EC had fallen short of international transparency standards.

"He also ruled that the EC had failed to refute allegations of malapportionment and gerrymandering which we raised in our case," Azmin said in a statement today.

He was responding to the EC chairperson Mohd Hashim Abdullah who had yesterday said that the court's decision proved that the EC did its duty in a transparent manner in line with legislative requirements.

While yesterday's judgement was not in the favour of the Selangor government, Azmin said it did not vindicate the conduct of the EC in any way.

"If Mohd Hashim had actually been present in the courtroom yesterday, he would realise that the court's decision offered no basis whatsoever for the EC to be regarded as transparent.

"I was there myself to witness the judgement on the case brought by the Selangor government.

"I heard the learned judge describe how his decision was tied by that of a higher court, the Court of Appeal," Azmin said.

Justice Azizul Azmi Adnan, who presided over the case, also encouraged their lawyers to pursue an appeal in another court, he added.

Azmin said the judge also granted a stay on the decision as requested by the Selangor government lawyers, which prevents the EC from conducting an inquiry on the grouses of voters in Selangor.

"I saw for myself how the EC'S lawyer slammed the door after hearing the learned judge grant Selangor a stay on the execution of his judgement," the PKR deputy president said.

He also said the Selangor government will continue to pursue the case as part of the fight to have free and fair elections.

In a separate statement, PKR's Padang Serai MP N Surendran also slammed the EC chairperson on similar points.

Surendran said the court found that the actions of the EC did not legally bind and adversely affect the state government, but that this does not mean the redelineation was "properly or fairly done".

The court saying that the EC fell short of international transparency standards reinforces complaints about the conduct of the EC, as there can be no fairness without transparency, he said.

He also criticised the EC for failing to rebut the allegations of malapportionment and gerrymandering.

"The EC and BN leaders have repeatedly denied that there has been malapportionment and gerrymandering in the redelineation exercise, but when given the opportunity to rebut the allegations in court, they failed to do so," he said.

As such, he called for the EC and Prime Minister Najib Abdul Razak to explain to the public, the poor transparency standards and the allegations of malapportionment and gerrymandering.
